Bell-Work Use your cellphones to discover and describe why President’s Day occurs on the 20th of February every year.

Adoption, Foster Care, Custody

Adoption The legal process by which an adult or adults become the legal parent(s) of another person. Typically adoption is of a child by an adult May be adoption of an adult by another adult. Typically set up through public or private adoption agencies Process Locate an agency Agency determines suitability of parents Court hearing for legality Children over a certain age (12 or 14) must also consent to the adoption

Foster Care Foster parents provide care to minors at the direction and under the supervision of the court or agency. Typically paid for service Children may be removed at any time Have few legal rights.

Custody

Custody means … Who will be the primary caretaker of the child(ren)? With whom will the child(ren) live? Parent (custodial parent) with custody makes the majority of important life decisions for the child until age of majority (18). Noncustodial parent may be granted visitation and/or be required to pay some sort of child support. Joint custody occurs when both parents have equal say in child(ren) decisions – child lives with both parents (though may not be equally). Decision is determined by the “best interest” of the child(ren)

It is possible to kidnap your own child, provided that you do not have legal custody of the child.

Spousal & Child Abuse Can occur against a man or a woman It is a crime to rape ones spouse, and the assaulted spouse may also file civil damage suits. Infliction or threatening of intentional physical, emotional, or sexual harm. Child Neglect is the failure to properly feed, clothe, shelter, educate, or tend to the medical needs of a minor. You have a civic duty to report suspected neglect or abuse, which is founded in good faith (reason to believe).

Odds and Ends

Alimony, Property Division, and Child Support Alimony may be awarded to either a man or a woman. It is based on need, and therefore the amount changes case to case. Courts consider the couples standard of living, financial status of the couple, and wage capacity of each. Not always awarded May be granted until skills are acquired for employment In community property states all property gained during marriage is divided equally. In other states the court decides what is equitable or fair. Custody was discussed in a previous slide. Child support is determined by parent income, number of children, and child’s age. Typically paid until age 18 or until emancipated. In Kentucky, failure to pay child support will place a person in jail.

Privileged Communications and Inheritance Neither person can be forced to testify against the other. In 1980, the Supreme Court decided that a spouse could testify against the other spouse without the consent of the other spouse. Parent and Child communications are not considered privileged.
