SEPARATION PAY ELEMENT 43

PURPOSE Inform members of the entitlement of separation pay Not every Service Member is eligible

STANDARD To monetarily assist certain involuntarily separated or released members from active duty Eligibility determined by the type of separation Separation Program Designator (SPD) code identifies members eligible for pay

GENERAL ELIGIBILITY Finished first term of enlistment or period of obligated service At least six years of service Separating involuntarily Not yet eligible for retirement Not separating under adverse conditions

REQUIREMENT FOR SERVICE IN READY RESERVE As a condition of receiving separation pay the member shall be required to enter into a written agreement to serve in the Ready Reserve for a period of not less than three years following discharge from active duty Failure to be accepted does not affect separation pay

RATES OF SEPARATION PAY Full: same requirements as general eligibility members are eligible for retention Half: same requirements as well except members are not eligible for retention

PERSONNEL NOT ELIGIBILE Members of the Navy Reserve discharged while on inactive duty Released from active duty for training Eligible for retainer or retirement pay immediately upon discharge Upon separation, Service member is retained on active duty in either an officer or enlisted status Service members separated during an initial enlistment or period of OBLISERV

CONTINUED… Separation initiated by service member Separation is directed as part of the execution of a court-martial sentence, which includes discharge or dismissal Separation is characterized as other than honorable Enlisted Service members separated because of misconduct or unsatisfactory performance
