Water Act An Act to provide for the development and utilisation of the water resources of Zimbabwe. Catchment area- means the area which naturally drains into a dam or a watercourse and from which the dam or watercourse receives surface or ground flow which originates from rainfall. Catchment council-

Water Act Ground water- All water which is beneath the surface of the ground and is not visible on the land concerned. Sec 32 -Use of water for Primary purposes The reasonable use of water for basic domestic human needs for the support of animal life, for the making of bricks for the private use of the owner.

Water Act Any person may abstract water for primary purposes. Only if they have lawfully access to the water. Construction of water storage works for primary purposes If capacity ≤ 5000m³ Notify in writing The catchment council, Every owner or occupier of riparian which is contiguous to the water works. Every contiguous owner may benefit from the water works if they agree to pay a proportion of the cost of the construction and maintenance of the water works. If capacity ≥ 5000m³ Apply for a permit – section 34. No person shall abstract water for any purpose other than primary purposes except in terms of a permit.

Water Act A permit shall, on the transfer of the piece of land to which it relates, pass to the new owner of the piece of land concerned. No person shall cede, sell or otherwise alienate a permit except with the consent of the catchment council concerned. Whenever a public stream which forms the boundary between two or more pieces of land changes its course the boundaries of such pieces of land shall not thereby be changed.

Water Act Public stream means a watercourse of natural origin in which water flows. Riparian land means land on which, or along the boundary of the whole or any portion of which, a public stream exists. Riparian owner means the owner of riparian land.

Water Act Whenever a piece of land in respect of which a permit has been granted is to be consolidated or subdivided, the owner shall prior to the subdivision or consolidation , lodge with the catchment council an application for the allocation, apportionment or revision of the permit.

Servitudes in respect of water Servitude of abutment – means the right to occupy and use by means of water works the banks or bed of a public stream or land adjacent thereto belonging to another. Servitude of passage- means the right to occupy and use so much land belonging to another as may be necessary for the passage of water. Servitude of purification- means the right to occupy and use so much land belonging to another as may be necessary to the filtration and purification of water. Servitude of storage- means the right to occupy and use land belonging to another by inundating it with water by means of water storage works.

Water Act For the purpose of registering a servitude which cannot adequately be defined by description a diagram prepared in accordance with the land survey Act shall be submitted showing the land subject to, and situation thereon of, the servitude.
