THE FACTS ABOUT FORM I-9 COMPLIANCE The Facts About Non-Compliant Form I-9s THE FACTS ABOUT FORM I-9 COMPLIANCE If your Form I-9s are not in full compliance, your organization is at risk of costly fines or penalties. Fines and penalties are enforced by Immigrations and Customs Enforcement (ICE), a division of the Department of Homeland Security (DHS). Failing to comply with Form I-9 regulations can result in fines ranging from $216 to $2,156 per employee, and other courses of action including jail time or debarment from government contracts. Did you know? On average, over 68% of Form I-9s are found to contain errors or omissions. These administrative mistakes are considered non-compliant and can be easily made when manually filling out each Form I-9. A missing date, signature or the wrong information in a field can land your company in hot water. You must maintain and purge Form I-9s according the 3 year/ 1 year rule or you will be out of compliance.

Why You Should Not Manually Correct Form I-9 THE FACTS ABOUT FORM I-9 COMPLIANCE Mistakes can happen at various stages of the employment verification process, including the completion of paper Form I-9. Though it is imperative that errors be promptly corrected, employers need to be careful that they do not replace old mistakes with new ones. The government guidelines for compliantly correcting Form I-9s are complicated, and if you fail to properly follow instructions you may increase your chances of facing harsh penalties.

Pay $2,156 for each bond the employee paid to the employer. Refund the employee the full amount of the bond. If the employee cannot be found, this refund will go to the U.S. Treasury. Criminal Violations Engaging in a pattern or practice of hiring, recruiting or referring for a fee unauthorized aliens. Up to $3,000 per unauthorized alien. Up to 6 months in prison for the entire pattern or practice.
