Interview vs. Interrogation

Is (S)He Lying to me? Get these questions answered. . . Ever wondered where your boyfriend was last night? Is she telling the truth about her past relationships? Is my friend really that stupid? How do my parents or officers know I just lied to them?

Things to focus on Objectives I can . . . Define Interview Define Interrogation Identify safety concerns with contact in the public Identify when a suspect needs to be mirandized Describe what eye movement will tell about truth of statement Identify the steps of the Reid Method Compare and contrast interview and interrogation Conduct a successful and safe interview Conduct a successful and safe interrogation Mirandize a suspect Identify when a person is lying based on body language

Interview Interview & Interrogation Purpose- to gain information about a specific crime or event Non-invasive Questioning is in a persuasive manner or tone Keep level tone and appeal to helping the public

Interview Many communities will not talk to the police May need to ask to step inside to get information May need to ask to call them later and do a phone interview May need to have them come to the police station

Interview Generally completed door to door-canvas Once information is gained you can be more specific and interview specific people SAFETY CONCERNS! Do not stand in front of the door when knocking Have people either step out or enter the house when questioning

Interviewing People Where to place your hands Where to stand Always keep your hands in front of you Always keep your hand raised Always keep your gun hand free Where to stand Approximately 5 feet from suspect or just out of arm’s reach Stand bladed Gun side away from the suspect

Interrogation Purpose- in order to get a confession Make sure you mirandize the individual Great to have props

Interrogations Environment Uncomfortable Leave them in a room for a while by themselves One way mirror, or any mirror Do not have anything around them to play with

Starting the Interrogation Build a rapport Talk about weather Things he/she may like or dislike Claim you like some of the same things Once an individual starts talking, it is harder for them to stop Once he is telling the truth about harmless things it becomes harder to lie and lies become more evident Develop a “baseline” of truth and lie reactions

The Baseline Pay attention to eye movements especially in information recall Pay attention to posture when certain questions are asked Look for any little quirks that may throw off whether the suspect is lying or telling the truth

What the Eyes Tell…. The next slide is a generality for Right handed person From your viewpoint No mental disability Not concrete Usually opposite for left handed people Need to ask questions to get a control

The Interrogation Move into it casually I guess you may know why you are here Why do you think you are here? Present the facts to the suspect Be deliberate, direct and accusatory Feel free to invade the suspect’s personal space

Interrogation Basically the best way is to be their friend and stab them in the back You are allowed to lie to them The lie cannot violate the “public decency” Make sure you can back up the lies and props Can even promise to help them out…make sure you do not promise lesser sentence Promise that you will talk to DA and try and get sentence lowered

Methods Reid Method Good cop bad cop method You’re a good person method Way out method Let them Brag

Reid Method Confrontation-Inform suspect confidently of case against them Theme Development-A story made up of why the suspect committed the crime Stop Denials-interrupt them immediately Overcome Objections-different than denials and can provide information

Reid Method Get Suspect’s Attention by being his friend Suspect Losing Resolve-head down, elbows on knees, allows you to move in…push toward confession Alternatives-offer to contrasting motives Encourage conversation-let him tell his story Confession-have suspect write it out

Conclusion If you can invade their space close up, it is time to press for confession If they ask for a lawyer you have to stop Make sure you mirandize Have fun…it’s a game…see who wins!

Exit Slip Why would you want an uncomfortable interrogation room, when an interview can be done anywhere? What would the most successful interrogation method be to use against your best friend? Why? Why would an officer speak to a person differently in an interview and interrogation?
