Challenges Facing Islamic Finance: Research Areas IRTI DLP - 2006 Lecture 9 Challenges Facing Islamic Finance: Research Areas Prof. Dr. Sayyid Tahir IIIE, IIU, Islamabad

1. The Methodological Issues The Hadith of Sayyidena Mo’az b. Jabal, and the existing methodology of the fiqh A Reinterpretation of the above Hadith, and its methodological implications 25 April 2006 DLP Lecture No. 9

وَلَقَدْ ضَرَبْنَا لِلنَّاسِ فِي هَذَا الْقُرْآنِ مِنْ كُلِّ مَثَلٍ لَعَلَّهُمْ يَتَذَكَّرُونَ (27) [الزمر: 27] We have put forth for men, in this Qur’an every kind of parable, in order that they may receive admonition. [Az-Zumur 39: 27; emphasis added] وَلَقَدْ صَرَّفْنَا فِي هَذَا الْقُرْآنِ لِلنَّاسِ مِنْ كُلِّ مَثَلٍ وَكَانَ الْإِنسَانُ أَكْثَرَ شَيْءٍ جَدَلًا (54) [الكهف: 54] We have explained in detail in this Qur’an, for the benefit of mankind, every kind of similitude: but man is, in most things, contentious. [Al-Kahf 18: 54; emphasis added] وَلَقَدْ صَرَّفْنَا لِلنَّاسِ فِي هَذَا الْقُرْآنِ مِنْ كُلِّ مَثَلٍ فَأَبَى أَكْثَرُ النَّاسِ إِلَّا كُفُورًا (89) [الاسراء: 89] And We have explained to man, in this Qur’an, every kind of similitude: yet the greater part of men refuse (to receive it) except with ingratitude! [Al-Asraa’ 17: 89; emphasis added] 25 April 2006 DLP Lecture No. 9

يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُوْلِي الْأَمْرِ مِنْكُمْ فَإِنْ تَنَازَعْتُمْ فِي شَيْءٍ فَرُدُّوهُ إِلَى اللَّهِ وَالرَّسُولِ إِنْ كُنتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ ذَلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا (59) [النّساء] O ye who believe! obey Allah, and obey the Messenger, and those charged with authority among you. If ye differ in anything among yourselves, refer it to Allah and His Messenger, if ye do believe in Allah and the Last Day: that is best, and most suitable for final determination. [An-Nisaa’ 4: 59] 25 April 2006 DLP Lecture No. 9

A suggested methodology for the Fiqh Let us work out the principles for permissible forms of transactions in the Qur’an and the Hadith. For any given case, we may check the goal or purpose of the various stakeholders and the permissibility or otherwise of that goal. If the goal at hand is recognized in the Shari’ah, we may work out the practical arrangement in the light of the principles mentioned above. 25 April 2006 DLP Lecture No. 9
