API Antitrust Guidelines It is API’s policy to comply with the antitrust laws. API staff and member company representatives should observe the following guidance: No discussion or forecasting of prices for goods or services provided by or received by a company. No sharing or discussing any company’s confidential or proprietary information. No discussion of an company’s specific purchasing plans; merger/divestment plans, production information, inventories or costs. No sharing or discussion of specific company compliance cost, unless publicly available. No agreement or discussion regarding the purchase or sale of goods or services (such decisions are independent company decisions). No discussion of how individual companies intend to respond to potential market/economic scenarios or government action; discussion limited to generalities. No disparaging remarks regarding specific vendors, products or services. If a discussion presents an antitrust issue, raise your concern immediately. If the discussion continues, announce that you are leaving the meeting because you have an antitrust concern, and immediately report your concern to API’s Office of the General Counsel and to your company’s own counsel. For API Standards Development Maintain written meeting minutes and obtain advance legal clearance from API for all written presentations. Make sure everyone materially affected by an adoption or revision of an API standard has an opportunity to comment. Confer with legal counsel beforehand if you believe any antitrust issues could arise. This Reference is not a comprehensive summary of antitrust issues, nor is it a substitute for legal advice. Antitrust issues should be raised with API’s Office of the General Counsel and/or the member company’s own antitrust counsel.

CRE Highlights CRE News – 25 standards published in 2015, (551?) Annual CRE budget: 2015- $870K, 2016- $675K Standards with CSB recommendations / comments 521- Changes on the use of Blowdown systems from CSB recommendation, but it doesn’t disallow which CSB recommended. Sent response letter to CSB. Update- still waiting on CSB response. 691 Risk Based Machinery Management- Approved but 2 negative ballots to resolve. 941 HTHA, revised based on CSB recommendations. CSB has reorganized, waiting to see if this changes anything with how they operate. To level workload SCHTE has developed a 10 yr plan to maintain their standards.

Standards Updates Reaffirmation ballots RP’s to reaffirm: RP 552 Transmission Systems RP 554 Parts 1 through 3 Even though the new revisions are close to ballot they are or will be past due before publication of the next version. All 4 have already been extended; a one time extension can be granted by the CRE for a two year period. RP 552 Due date with extension was 2014 RP 554 Part 1 Due date with extension was 2014 RP 554 Part 2 Due date with extension is 2015 RP 554 Part 3 Due date with extension is 2015 Reaffirmation is good for another 5 years RP 552 passed with no comments to resolve RP 554 Parts 1-3 out for reaffirmation ballot now Expect both RP’s to ballot in early 2016 and hope to be able to work on comments at the Spring 2016 meeting.

RP 552 Status- Gary Hawkins RP 554 Parts 1, 2, & 3 Status – Ready for ballot once reaffirmation is completed. RP 553 Status- Start revision this week. RP-556 Status- Original due date of 2016, extended for 2 years.

SOICS Fall Meeting OSHA RAGAGEP Letter OSHA issued memorandum in June providing REGAGEP guidance to regional administrators Effectively makes a “should” a “shall”, for an API document, it doesn't matter if it’s an RP or STD, all treated as a STD Approximately 12K instances of “shoulds” becoming “shalls” in API documents OSHA didn’t follow rule making laws, primarily the Administrative Procedures Act (APA) as required API filed suite against OSHA OSHA responded and is in settlement discussions with API, not yet shared with the general membership where the negotiation is headed.
