JOURNEY OF ICSI INSOLVENCY PROFESSIONALS AGENCY (ICSI IPA) (25th November, 2016 to 24th November, 2017)

ICSI Insolvency Professionals Agency (ICSI IPA) is a frontline regulator registered with Insolvency and Bankruptcy Board of India (IBBI) under the Insolvency and Bankruptcy Code, 2016 (Code). ICSI IPA had enrolled a total of 221 Insolvency Professionals (IPs) with it during the limited period and at present, more than 450 IPs are enrolled with it. It is pertinent to mention here that leading practitioners from the legal fraternity and other professional avenues have chosen to get themselves enrolled with ICSI IPA.

TRAINING AND DEVELOPMENT INITIATIVES In order to support the IPs in establishing themselves in the new insolvency regime ICSI IPA has been organising various webinars/programmes/ workshops/interactive meetings on a regular basis. WEBINAR SERIES ON INSOLVENCY AND BANKRUPTCY CODE, 2016 Webinar on “Insolvency Law and Role of Insolvency Professionals” was organised on 17th January, 2017. Webinar on “Corporate Insolvency Resolution Process- Procedures and Challenges (Part- I)” was organised on 20th April, 2017.

Webinar on “Corporate Insolvency Resolution Process- Procedures and Challenges (Part- II)” was organised on 4th May, 2017. Webinar on “Cases and Challenges under the Insolvency and Bankruptcy Code, 2016” was organised on 25th May, 2017.

INTERFACES ON INSOLVENCY AND BANKRUPTCY CODE, 2016 Interface on Opportunities & Challenges for Insolvency Professionals under the Insolvency and Bankruptcy Code, 2016 was organised on Tuesday, March 7, 2017 at PHD Chamber of Commerce & Industry. Hon'ble Justice S. J. Mukhopadhaya, Chairperson, National Company Law Appellate Tribunal (NCLAT) was the Chief Guest and Dr. M. S. Sahoo, Chairperson, Insolvency and Bankruptcy Board of India (IBBI) was the Guest of Honour of the program.

INTERACTIVE SESSION ON INSOLVENCY AND BANKRUPTCY CODE, 2016: ISSUES, CHALLENGES AND CASE ANALYSIS Interactive Session on Insolvency and Bankruptcy Code, 2016: Issues, Challenges and Case Analysis was organised on 18th May, 2017 at the SCOPE Complex, Lodhi Road, New Delhi, wherein Hon’ble Justice  Shri S J Mukhopadhaya,Chairperson,NCLAT,  Ms.Suman Saxena, Whole Time Member,   IBBI,  Mr. Balvinder Singh, Member (Technical), NCLAT, Mr. Amarjit Singh Chandhiok, President INSOL India and Senior Advocate  and CS Satwinder Singh, Council Member, ICSI & Advocate & Partner, Vaish Associates interacted with the participants.

CERTIFICATION COURSE ON INSOLVENCY AND BANKRUPTCY CODE, 2016 ICSI Insolvency Professionals (ICSI IPA) has started organising intensive training programmes in the form of 3 days Certification Course on Insolvency and Bankruptcy Code, 2016 (Code) on PAN India basis. The pilot Certification Course was organized at: Delhi on 5th to 7th October, 2017 Mumbai on 12th to 14th October, 2017

STUDY CIRCLE MEETING ON EMERGING CASE LAWS ON ROLES, POWERS, DUTIES AND CHALLENGES: IRP/RP ICSI Insolvency Professionals Agency organised a study circle meeting on the topic “Emerging Case Laws on Roles, Powers, Duties and Challenges: IRP/RP” on September 23, 2017 (Saturday) at NIRC-ICSI, Prasad Nagar Institutional Area, New Delhi.

ROUNDTABLE ON DRAFT REGULATIONS ON INDIVIDUAL INSOLVENCY A roundtable of trade associations and insolvency professionals was held at Kolkata on November 3, 2017 from 11:30 a.m. to 1:30 p.m. at Merchants Chamber of Commerce & Industry , 15-B, Hemanta Basu Sarani, Kolkata - 700 033 to invite stakeholders comments on the abovesaid regulations/rules,  with the representatives of  senior officials of Insolvency and Bankruptcy Board of India A roundtable of trade associations and insolvency professionals was held at Mumbai  on October 31, 2017 from 2:00 p.m. to 5:00 p.m. at ICSI-WIRC, 13, 56 & 57, JOLLY MAKER CHAMBERS NO. 2 (5th FLOOR) NARIMAN POINT, MUMBAI – 400021 to invite stakeholders comments on the abovesaid regulations/rules,  with the representatives of  senior officials of Insolvency and Bankruptcy Board of India .

PUBLICATIONS RELEASED BY ICSI IPA INSOLVENCY AND BANKRUPTCY MANUAL   This publication covers all the developments under the insolvency law, right since inception till the very latest are present at one place as Ready Reckoner PRONOUNCEMENTS UNDER THE INSOLVENCY AND BANKRUPTCY CODE, 2016 – ISSUE ANALYSIS Publication addresses various issues, which are being settled through different judicial pronouncements by Hon’ble Supreme Court of India, High Courts,  NCLAT and different benches of NCLT

Practical Aspects of Insolvency La w This publication is an attempt to focus on practical aspects of Corporate Insolvency Resolution Process (CIRP) including model applications, resolution plan, information memorandum etc. IBC Case Law Compendium (With Case Briefs): The book enjoys the privilege of being first of its    kind compiling all orders issued by various benches of NCLT, along with case briefs upto 30th April, 2017 .

Interim Resolution Professional- A Handbook This publication is a handy reference for the IRPs as it also consists of specimens of report constituting Committee of Creditors, application to NCLT for non-cooperation by personnel etc. Insolvency and Bankruptcy Code, 2016 (With Rules & Regulations) - Updated Edition This publication is a compilation of the regulatory aspects of the Code covering the rules, regulations and notifications issued thereunder.

Corporate Bankruptcy – A Primer This Publication covers basics of corporate insolvency resolution process under “The Insolvency and Bankruptcy Code 2016”.

Brochures and Booklets Brochure for Bankers “The Insolvency and Bankruptcy Code, 2016– A Boon for Bankers” ICSI IPA brought out a brochure for bankers, with an objective to disseminate critical information that a banker should know about the code. This brochure was circulated to 350 bankers involved in stressed assets.

Booklet for Masses Insolvency and Bankruptcy Code, 2016: Resolving Insolvency (Simplified Guide) The booklet is an attempt to spread awareness about the Code amongst all stakeholders covering the broad structure of the code, circumstances under which one can invoke the code, process of insolvency resolution, benefits available. This Booklet is available in English Hindi

Knowledge Reponere – A Weekly Update ICSI IPA brings out a weekly update to enable its professional members to be abreast with the latest amendments, notifications and case laws filed under the Code. So far.....weekly updates has gone to the members.

ICSI IPA INSOLVENCY AND BANKRUPTCY JOURNAL ICSI IPA has taken this maiden initiative to bring out this monthly Journal which is the very first of its kind to incorporate the latest in the insolvency law including recent regulations and notifications brought out by the Regulator under the Code, the gist of the landmark judgments pronounced by NCLAT and the various benches of NCLT, articles from experts in the field and the contemporary advancements taking place globally in the field of insolvency and bankruptcy.

ONLINE MOCK TEST ICSI IPA with the support of the IT team of ICSI has developed an Online Mock Test based on the latest syllabus of the Limited Insolvency Examination. Presently, about 8100 professionals have attempted this online mock test.

ONLINE REGISTRATION PROCESS In our constant endeavour enhance and streamline our existing framework, ICSI Insolvency Professionals Agency (ICSI IPA) has introduced the Online Registration Process for the ease of the applicants. An eligible individual who has cleared the Limited Insolvency Examination may now apply online for enrolment as a professional member with ICSI IPA by logging into the following link http://icsiipa.com/registration.

WAY FORWARD..... International Conference on IBC ICSI IPA proposes to organise an International Conference on IBC in the month of January 2018 wherein a galaxy of experts from around the globe shall be roped in to share their experiences with the delegates at this International Conference. The International Conference shall be a learning opportunity for the IPs and the other relevant stakeholders who shall get an opportunity to interact with eminent speakers and faculty from all over the world. Training Program With World Bank Group ICSI IPA has joined hands with World Bank Group for organising a training programme for the capacity building of Insolvency Professionals registered with ICSI IPA in the month of January, 2018.  

Moot Court Competition As a measure of awareness, ICSI IPA proposes to host/promote moot competitions at National Law Schools, for the Students of ICSI etc
