Background 2000: Water Concurrency TZO adopted which imposed zoning regulations in the Basin that tied development and the issuance of building permits to the availability of water (not just paper water rights). 2000-2005: Various Ordinances were adopted to regulate water concurrency. 2005: Water Concurrency Ordinance added to the Development Code. June, 2016: Board of Health adopted concurrency regulations in the Health Code. August 23, 2016: SBPC unanimously forwarded a positive recommendation to SCC for amended language.
Willing to Serve Letter Required Prior to Development Permit Approval A letter issued by a water supplier indicating that they will provide water service to a project or new development, provided the applicant complies with all the terms of the agreement. Prior to approval by Summit County of a development permit.
Commitment of Service Letter Required Prior to Building Permit Approval An irrevocable contractual commitment in letter form issued by a water supplier to a developer or customer, in consideration for payment of the water supplier’s impact fee or connection fee. Prior to approval by Summit County of a building permit for any development.
Recommendation Staff recommends that the SCC conduct a public hearing and vote to approve the amendments through the adoption of Ordinance 861, based on the FOF and COL found in the staff report dated September 28, 2016.
