09/219 SHEC-meeting 2009-09-28 Emission of dangerous substances - mandate M/103 Robert Walter 28/09/2009

Relevant regulations for EN 13165 (PU) EGDS – Expert Group of Dangerous Substances Proposal DS 110 - 2009-08-13 - Regulation 552/2009/EC (pentabromodiphenylether, octabromodiphenylether, cadmium) - Regulation 1907/2009/EC (candidate list: DEHP, DBP, BBP) - REACH - Commission Decision 2009 /425/EC (organostannic compounds) - PL-1996 (DBP) - 2005-9020-N (decabromo-diphenylether) - 2001-121-DK, 2005-485-A (HFC) - 2008-273-FIN (pentane, isocyanates, TBP, TPP) - 2007-9016-N (cadmium) - 2009-34-F (trichloroethylene) - 2009-104-F (benzene, DEHP, DBP)

Relevant substances for EN 13165 (PU) EGDS proposal (DS 110 - 2009-08-13) hydrofluorocarbons (HFC), pentabromodiphenylether, octabromodiphenylether, decabromodiphenylether, diethylhexylphthalate (DEHP), dibutylphthalate (DBP), benzylbutylphthalate (BBP), Tri-substituted organostannic compounds, Dibutyltin (DBT) compounds, isocyanates, pentane, tributylphosphate, triphenylphosphate, trichloroethylene, benzene, cadmium

TC88 answer: no relevant regulations In doc. DS 110 EU directives and notifications are quoted which do not apply to construction products with respect to the CPD/ER 3 and M/ 366. Directive 2007-9016 refers to consumers goods; thermal insulation materials are construction products; Reference to the draft candidate list of Regulation (EC) 1907/2006 (REACH) makes no sense in this context. REACH is for declaration of chemicals and not for CE marking. Conclusion of TC88: There are no notifications quoted, which are related directly to the TC88 thermal insulation products. Therefore no regulated dangerous substances can be quoted for the mandat. Problem: EGDS will not accept this TC88 position !!??

WG6 answer to quoted substances: most of listed substances not relevant The following is proposed to be included for amendment of M/103 regarding EN 13165 for PU: EN Number Standard Title Requirements: in contact with soil Requirements: contact with indoor air possible Requirements: no contact with indoor air or soil Regulations EN 13165 xxxx Not relevant HFC, pentane, TVOC, TSVOC
