Limited Scope Representation “Unbundling” What lawyers need to know about unbundling

Limited Scope Representation What it is NOT For every case For every issue For every client Second class practice Limited Scope Representation

What is Limited Scope Representation Ethical Safe Limited scope Practice of law Attorney-client relationship Profit center Ethical- Attorney Regulation only reports one case where a lawyer, accused of not following through with a case, try to claim unbundled. There was no agreement or other evidence that suggested the lawyer took the case as limited scope. Practice of Law: Lawyers have incorporated limited scope representation in their practices forever.

Why Limited Scope Parties without Attorneys: FY 2015 Domestic Relations: 75% of Petitioners and 75% of Respondents County civil (debtor/ creditor, FED’s) respondents: 98% Public believes they can not afford a lawyer People want a lawyer. Even those who believe that they can handle their case, become confused, lost, perplexed. The State Court Administrator’s Office compiles statistics on the number of cases and number of parties that appear in court with out lawyers. Latest statistics are in your materials.

Why Limited Scope Attorney View of Legal Issue Mediation Disclosures Attorney View of Legal Issue Litigant view of Legal Issue Legal Issue Mediation File case Trial Enforce court order Service of Process Collect judgment Legal Issue File case Trial As lawyers we see the entire picture of a legal issue, and how it will unfold in general.
