FEES FOR WASTE LANDFILLING – WHO PAYS? AMOUNT set by Ministry of Environment and Ministry of Finance FEE IS PAID: waste producer who landfills its waste landfill operator (waste producer) and this landfill is located on its own property FEE IS NOT PAID: for depositing waste as technological materials (max. 25 %) for technical securing of the landfill Must be in accordance with the approved project and rules of operation of the landfill

FEES FOR LANDFILLING 2009 19 Increasing trend of fees (EUR/tonne/year) Rate 1 EUR = 27.50 CZK 05 - 06 07 - 08 09 - 10 11 and further Hazardous 44 52 62 80 Household and other 11 15 28 Additional risk (hazardous) component 91 121 164 215 PROPOSAL 19 Kontrola plateb a poplatků: Kontrolu placení poplatků provádí u provozovatele skládky obec a krajský úřad Pokud provozovatel skládky neodvedl obci nebo SFŽP vybraný poplatek ve stanovené lhůtě, uloží povinnost zaplatit poplatek krajský úřad Poplatky a penále vymáhají celní úřady místně příslušné katastrálnímu území Zvýšení poplatků za skládkování od roku 2009 a změna konstrukce poplatků. Základní poplatek - příjmem obce Rizikový poplatek – příjem SFŽP Příjemcem navýšené částky poplatku v novele zákona bude kraj. Příjmová část rozpočtu SFŽP byla ke dni 31.12.2005 splněna na 105,7 % stanoveného plánu.Příznivý vývoj plnění je způsoben zejména vyšším výběrem poplatků ve složce odpady, kde došlo vlivem působení zákona o odpadech ke změně sazby za ukládání odpadů – zdroj. Výroční zpráva SFŽP v roce 2005. Příjmy z plánovaných 130 mil Kč se zvýšily o 63,7 % na 193, 7 mil. Kč.

Asbestos waste is hazardous waste but „political“ exemption – only BASIC FEE PAID

FEES RECIPIENTS FEE is income for the Municipality within whose cadastral territory the landfill is located, and for the Czech State Environmental Fund If municipality is producer and deposits waste in landfill located within its territory, the basic component of the fee is NOT paid by the municipality Payment of fees by the landfill operator is CHECKED by the MUNICIPALITY AND THE REGIONAL AUTHORITY, within whose cadastral territory the landfill is located

PENALTY FOR FEES NON-PAYMENT Landfill operator does NOT pay to municipality or State ENV Fund ► new deadline is set ► duty to pay set by regional authority ►+ fines of 0.5 ‰ of the withheld amount per day must be paid in case of failure to levy the fee. Fines are income for the municipality Fees and fines are exacted by the financial authorities that are locally competent for the cadastral territory, where the landfill is located ► Act No. 337/1992 Coll., on administration of taxes and fees, as amended.

FINANCIAL RESERVE FOR RECLAIMING AND DECONTAMINATION OF LANDFILLS OBLIGATION of the Landfill operator recovery, maintenance, monitoring and decontamination after closure of the landfill Financial reserve: - is included in the costs for landfilling - creation constitutes an expenditure provided for obtaining, maintaining and securing income, (Act No. 586/1992 Coll., on income taxes) - is deposited in a special bank account. The financial reserve may not be subject to an order for and implementation of enforcement of a decision or included in the bankruptcy assets of the landfill operator, landfill owner or their legal successors

FINANCIAL RESERVE FOR RECLAIMING AND DECONTAMINATION OF LANDFILL II Financial reserve must be created: - for each landfill operated (1 company – 3 landfills = 3 special accounts) Special ESCROW account must: - indicate which landfill is covered by the financial reserve - contain a provision that the account is a special escrow account managed by the bank pursuant to recovery, maintenance and decontamination after closure of the landfill - be disposed of, after the date of its establishment, only with the consent of the regional authority competent pursuant to the location of the landfill

MONEY ON THE SPECIAL ESCROW ACCOUNT - be disposed of, after the date of its establishment, only with the consent of the regional authority competent pursuant to the location of the landfill - must be transferred always by operator by the last day of the subsequent calendar month - in case of change and new landfill operator on the market ► AGREEMENT is necessary on transfer of the financial reserve between old operator and the new one - fund may be drawn from the financial reserve only with the consent of the regional authority only for reclamation, maintenance of the landfill after closure and decontamination

PERIOD OF THE MAINTENANCE and RECLAMATION Set by the competent regional authority Regional authority stipulates the period and conditions of maintenance of a landfill after closure of the landfill, reclamation, monitoring and decontamination separately for each landfill within its rules of operation The period may not be < 30 years
