What has to happen? “Provisional Application Phase so called “sunrise period” Ratification of UPC 14 countries have ratified UK is planning Germany (signature of the President is needed BUT)

BUT: Constitutional Complaint in Constitutional Court BUT: Constitutional Complaint in Constitutional Court. Court asks President not to sign! Complaint: UPC is not a national court but replaces jurisdiction of national courts and deals with EU law. This is contrary to EU Treaty. Language regime is contrary art. 47.2 and art. 48.2 of Charter of Fundamental rights. Court has no competence with respect to EPO’s decision not to grant. Board of Appeal is not independent judicial body.
