What is Involved in a Personal Injury Claim?

A Personal Injury Claim If you have been injured in an accident that was someone else’s fault and are thinking of filing a claim, it is important that you understand what is involved.

Hiring a Lawyer Your lawyer will investigate the circumstances of your case and determine if you are eligible to file for compensation. Delete the word Solicitor from graphic.

Attorney Communication Your attorney will communicate with the lawyer of the at-fault party to discuss compensation for the injuries you have sustained. The at- fault party’s lawyer may agree to the terms or attempt to negotiate a settlement.

Fact Finding The attorneys for both sides will review evidence such as police reports, witness statements, and medical records.

Filing a Lawsuit If a settlement cannot be reached after multiple negotiation attempts, your attorney may file a lawsuit with the appropriate court.

Negotiation and Settlement Negotiation and settlement may occur at any point during a personal injury case. Parties can negotiate and settle the case before trial. In many cases, a settlement is reached before trial. Delete the words BIG PAYOUT from graphic

If the Case Goes to Trial The jury will make the final decision about who was at fault and how much money should be awarded to the victim.
