District of Columbia v. Heller https://www.slideshare.net/WilliamKelley/district-of-columbia-v-heller1 By: Samuel and Kayleigh

Background of the case Dick Anthony Heller was a police officer in Washington D.C. He had a handgun at home. There had been a law passed that you had to keep your gun registered and disassembled. He went to and was dissmised from the District Court but the Circuit Court of Appeal said it was legitimate and the 2nd Amendment protected it. http://candrsenal.com/disassembly-czechoslovakian-vz-27-pistol/

The Essential Question Do the provisions of the District of Columbia Code that restrict the licensing of handguns and require licensed firearms kept in the home to be kept non functional violate the 2nd Amendment. http://www.cabelas.com/category/Semiautomatic-Pistols/105529680.uts https://www.tes.com/lessons/XPd4jw9ttLIU1g/proverbs-and-adages

The Constitutional Principles of the Case There is only one Constitutional Principle dealing with the case, and that is the Second Amendment. The 2nd Amendment means: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” https://www.linkedin.com/pulse/should-2nd-amendment-taken-literally-mike-chappell

Outcome and Why The Court decided that first clause of the 2nd Amendment that refers to “militia” is an introduction clause and does not limit the clause that lets the Amendment operate. They also decided that the term, “militia” should not refer only to people in the military but any able- bodied man back in the 1700s. They eventually sided with Heller in a 5-4 vote. https://www.punditmom.com/2007/05/ruth-bader-ginsburg-cant-do-it-alone

Impact on U.S. Why is it considered a landmark case? The result of this case allows people to keep and bear assembled handguns across the nation. This is a landmark case because it has made part of the constitution widely known and it is letting people know they are allowed to posses a handgun.
