INTERPERSONAL PROTECTIVE ORDERS Dating violence Stalking Sexual Assault IPO upon criminal conviction for stalking or sexual assault

DATING RELATIONSHIP HAVE OR HAVE HAD A RELATIONSHIP OF A ROMANTIC OR INTIMATE NATURE DOES NOT INCLUDE CASUAL ACQUAINTANCESHIP OR ORDINARY FRATERNIZATION IN BUSINESS OR SOCIAL CONTEXT SIX LISTED FACTORS COURT MAY CONSIDER

FACTORS DECLARATIONS OF ROMANTIC INTEREST RELATIONSHIP WAS CHARACTERIZED BY THE EXPECTATION OF AFFECTION ATTENDANCE AT SOCIAL OUTINGS TOGETHER AS A COUPLE FREQUENCY AND TYPE OF INTERACTION/INVOLVED TOGETHER OVER TIME/CONTINUOUS BASIS LENGTH AND RECENCY OTHER INDICATIONS OF A SUBSTANTIAL CONNECTION THAT WOULD LEAD A REASONABLE PERSON TO UNDERSTAND THAT A DATING RELATIONSHIP EXISTED

DATING VIOLENCE AND ABUSE Physical injury, serious physical injury, stalking, sexual assault or the infliction of fear of imminent physical injury, serious physical injury, sexual abuse or assault occurring between persons who are or have been in a dating relationship

STALKING intentional course of conduct (2 events) directed at a specific person(s) seriously alarms/annoys/intimidates/harasses no legitimate purpose causes a reasonable person to suffer substantial mental distress explicit/implicit threat with intent to place victim in fear of sexual contact, physical injury, death

SEXUAL ASSAULT Rape: sexual intercourse or penetration of the sex organs with a foreign object Sodomy: deviate sexual intercourse sex organ/mouth or sex organ/anus penetration of anus with foreign object Sexual Abuse: sexual contact - touching of sexual or other intimate parts of the body for sexual gratification of either party Incest: sexual intercourse or deviate sexual intercourse between ancestor/descendant, siblings, aunt/uncle/nephew/niece

SEXUAL ASSAULT - FORCIBLE COMPULSION physical force or threat of force express or implied fear of immediate death, physical injury/kidnapping of self or other physical resistance of victim not required

SEXUAL ASSAULT - INABILITY TO GIVE LEGAL CONSENT physically helpless(unconscious/unable to communicate unwillingness) mentally incapacitated(temporary/invol intox) intellectual disability/mental illness under 12 under 14 and respondent 18 or older under 16 and respondent 21 or older under 18 and respondent is in position of trust

DATING VIOLENCE Checking partner’s cell phones, emails, social media without permission Excessive checking up on partner with texts/calls Extreme jealousy or insecurity/possessiveness Constant belittling or put-downs Explosive temper Isolating the partner from family and friends Stalking

DATING VIOLENCE (CONT) Making false accusations of cheating Erratic mood swings Inflicting physical pain or injury at any level Possession/purchase of firearm Always telling the partner what to do/how to act/who to talk to or not talk to/what to wear or not wear Repeated pressure to have sex Sexual assault

STALKING Surveillance: following, showing up, spying, using technology to keep tabs on victim Life invasion: repeated unwanted contact, in person, by phone, text, email, social media Intimidation: implicit or explicit threats, forced confrontation, property damage Interference: disruption of victim’s personal, social and work life Assaults: physical, sexual

STALKING – REACTION OF VICTIM Resistance: repeatedly telling perpetrator they don’t want contact, changing phone numbers, locks, residence, travel routes or social hang outs, altering life to avoid contact Fear: for self or family/friends, even without prior assault or explicit threat Impact on life: disruption to victim’s personal, professional, social, academic life/relationships
