LE, Judicial & DMV Information Sharing Enforcement Standing Committee Mission ~ To inspire collaboration between Law Enforcement and Driver/Motor Vehicle Administrators to improve highway and public safety.   Goals of the Law Enforcement Committee Increase law enforcement participation in AAMVA conferences, working groups, and other initiatives. Provide and promote uniformity and consistency through the development of standards, model programs and best practices. Promote the exchange of challenges and successes implementation of technologies, sharing of information, and other contemporary law enforcement issues. I placed the AAMVA Enforcement Standing Committee Mission here because I think it’s important for people to understand what drives what we do and why we do it. All of the projects I will be sharing with you today are developed by Working Groups operating under the auspices of the Enforcement Standing Committee.

New Law Enforcement Solutions ~ 18-Wheels & BUSted The Montana Highway Patrol (MHP) has an authorized strength of 241 sworn Troopers. In 2005 CMV inspections were moved from MHP to the Montana Department of Transportation, Motor Carrier Services Division. MHP lost sight of the “Big Picture” as it related to CMV Safety. Over time, MHP noted that CMV enforcement efforts decreased and the CMV crashes increased. READ SLIDE

New Law Enforcement Solutions ~ 18-Wheels & BUSted Inspections This graph depicts the dramatic decline in CMV inspections by Montana Troopers immediately following the shift of responsibility from the Highway Patrol to the DOT … An outcome that was expected.

New Law Enforcement Solutions ~ 18-Wheels & BUSted In 2011 Montana experienced a total of 870 CMV crashes. Of those, 25 fatality crashes resulted in 34 deaths. This represented a 92% increase in CMV fatal crashes and a 100% increase in overall deaths over 2010. The correlation between reduction in overall CMV enforcement since 2005 and recent increases in crashes left MHP looking for a strategy to address this issue. However, what wasn’t expected was the dramatic increase in fatal CMV crashes. READ SLIDE

New Law Enforcement Solutions ~ 18-Wheels & BUSted In September 2011 AAMVA rolled out the “18-Wheels and BUSted” DVD. MHP Colonel Mike Tooley looked at this video as a opportunity to refocus the MHP mission as it relates to CMV enforcement. In October 2011 the video became mandatory training for all sworn MHP Troopers. In February 2012, MHP achieved 100% training completion. READ SLIDE

MHP/CMV Speed Enforcement New Law Enforcement Solutions ~ 18-Wheels & BUSted MHP/CMV Speed Enforcement This slide depicts an increase in CMV Speed Enforcement (a leading crash causing violation) following training. Increased enforcement is an output MHP is assuming will lead to the outcome of reduced crashes, deaths and injuries, but it will take a year of data collection to determine if that desired outcome was achieved.

The driver may speak little or no English; Officer unfamiliarity with documents that allow foreign nationals to legally drive; Officer unsure which documents validate identity and legal presence; The Officer may take the path of least resistance and release the driver without taking appropriate action (officer perception that issuing a citation is not effective because the driver will ignore/return to their country of origin before the court date); The traffic stop is not documented. One side has a work flow chart indicating what documents to ask for and a decision tree based on whether the documents are provided or not. New Law Enforcement Solutions ~ Suspended/Revoked Best Practice Guide Funded by NHTSA Completed August 2012 Developed by the Suspended/Revoked Working Group Deliverable #1: A publication titled “Alternative Solutions to Driver License Suspension for Non-Highway Safety Related Offenses”; and Deliverable #2: Model Legislation (template) Available on AAMVA Website This next solution is one we hope will help DMVs, Law Enforcement and the Courts. This is the cover of the document developed by the Suspended and Revoked Working Group titled “ALTERNATIVE SOLUTIONS TO DRIVER LICENSE SUSPENSION FOR NON-HIGHWAY SAFETY RELATED OFFENSES.” READ SLIDE

New Law Enforcement Solutions ~ Suspended/Revoked Best Practice Guide For decades, states used driver license suspensions and revocations as a tool to address poor driving. The Problem Every year, state legislatures pass additional laws requiring suspensions as a mechanism to gain compliance with non-highway safety (or social non-conformance) reasons, i.e., bounced checks, fuel theft, graffiti, truancy, etc. Suspensions for non-driving reasons rose from 29% of total suspensions to 39% of total suspensions in just 4 years. New Law Enforcement Solutions ~ Suspended/Revoked Best Practice Guide In 2004, AAMVA created the Suspended & Revoked Working Group under our Enforcement Standing Committee (funded by NHTSA) to conduct research, recommend a solution, and publish a best practices guide. The Research Research indicates drivers suspended for driver behavior are involved in crashes 3X more frequently than drivers suspended for non-driving reasons, and 6X more frequently than drivers who have never been suspended. New Law Enforcement Solutions ~ Suspended/Revoked Best Practice Guide The Best Practice Guide was just published. It recommends that legislatures repeal laws requiring the suspension of driving privileges for non-highway safety-related violations. The Best Practice Guide includes: The research behind the recommendation; and A model legislation template for jurisdictions to use to craft their own legislation. Adoption of these recommendations would reduce the burden on DMVs, LE, Courts, and society. READ SLIDE

New Law Enforcement Solutions ~ Improving Automated License Plate Reader Effectiveness through Uniform License Plate Design & Manufacture Funded by Customs and Border Protection (CBP) Completed July 2012 Developed by the ALPR Working Group Deliverable #1: A matrix identifying, by jurisdiction, the use of stacked letters, non-alphanumeric characters, and other unique license plate characteristics. Deliverable #2: Best Practice Guide for Improving Automated License Plate Reader Effectiveness through Uniform License Plate Design and Manufacture. Available on AAMVA Website The next Law Enforcement Solution, from the ALPR Working Group addresses Improving Automated License Plate Reader Effectiveness through Uniform License Plate Design and Manufacture. The Best Practices Guide will provide recommendations for standardized data elements for, and formatting of paper and/or electronic vehicle registration documents. Deliverable #2: A Best Practices Guide to be used by insurance companies. The Best Practices Guide will provide recommendations for standardized data elements for, and formatting of paper and/or electronic proof of insurance documents. Deliverable #3: A matrix depicting results of a survey of jurisdictions indicating those jurisdictions requiring proof of insurance by carried inside a vehicle and other pertinent survey questions determined by the Working Group.
