Introduction What is female foeticide? What is sex selection? Practice of determining the sex of an unborn foetus and eliminating it if found to be female. sex selection is also referred to as pre-natal elimination of girls. What is female foeticide? It is defined as aborting a female foetus after sex determination test. Ultrasonography helps determine abnormalities in the fetus, but it is misused to find out sex of the foetus and abortion is done if it is a girl.

Root Cause of Sex determination Poverty Lack of Education Low status of women and girls in a male dominated society The culture of son preference Monitoring of foetus sex determination Obsession for Son. Fear of dowry by many poor class families. Girls are considered as financial obligation by many parents. Advancement in technology , nowadays parent determines the sex of a child before birth.   Some of the doctors do this heinous act to fulfill their money desire.

PCPNDT-Introduction Pre-natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act enacted in 1994; came into force in 1996 Act amended in 2003: Renamed as the Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 Now includes prohibition of sex selection before and after conception Also regulates use of pre-conception diagnostic techniques for sex selection Central legislation; however, implementation completely rests with the States through decentralised implementing mechanisms (Appropriate Authorities) at the state/ district / sub-district level

How the Act works? PROHIBITON: Sex selection before or after conception and misuse of pre-natal diagnostic techniques for determination of the sex of the foetus Advertisements in relation to such techniques for detection or determination of sex REGISTRATION: Facilities providing pre-conception and pre-natal diagnostics capable of determining the sex of the foetus MAINTENANCE & PRESERVATION OF RECORDS: Prescribes formats including Form F SEARCH, SEIZURE & SEALING POWERS: Appropriate Authorities empowered with the powers of Civil Court

Who all are liable? Unit in-charge / owner Persons who perform the tests Mediator abetting pregnant woman’s access Husband / relatives of the pregnant woman The pregnant woman herself is considered innocent under the Act, unless proved otherwise Persons / units advertising about sex selection in any form

The Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 Pre-natal Diagnostic Techniques includes Ultra-sonography, Foetoscopy, Taking samples of amniotic fluid, embryo, blood or any tissue or fluid of pregnant women before or after conception, Testing samples in Genetic Laboratory to detect genetic disorders, abnormalities or sex-linked diseases

Imposes restrictions on: The Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 Imposes restrictions on: Clinics, medical personnel and sale of machines Only registered genetic clinics can use pre- natal diagnostic techniques By qualified medical practitioner Prohibition of sex-selection Prohibition on sale of ultrasound machine to unregistered laboratories, clinics & persons

The Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994 PNDT can be used for detection of abnormalities: Chromosomal Abnormalities Genetic Metabolic Diseases Haemoglobinopathies Sex-linked genetic diseases Congenital abnormalities Any other abnormalities

Integrated Monitoring System for PCPNDT Act IMPACT Software Integrated Monitoring System for PCPNDT Act Website Address - http://pcpndt.raj.nic.in

IMPACT Software The website was launched on 1st Oct, 2012. The website address is http://pcpndt.raj.nic.in. The system is designed and developed by the National Informatics Centre – Rajasthan. More than 1554+ sonography centres are registered online. More than one crore Form-F have been submitted online till date (since launch date). More than 8000 online Form-F are being submitted by centers on daily basis.- 30 lakh sonography p.a. More than 2666+ Tracking devices have been installed.

Tracking Device It is installed with Sonography machine in a tamper-proof manner. It has common power supply with Sonography machine. It captures the screen of Sonography machine and records it in compressed and encrypted form. It is able to store data for the period of 2 years. It sends the status through GPRS/ SMS signal. Tracking Device

Mukhbir Yojna Under the scheme, State Govt. has declared Award of Rs. 2,50,000/- to the “Mukhbir” for giving authentic information of sex selection. In 2016 25 decoy operations were conducted under this scheme. (Total 111 Decoy Operations conducted in the State including 42 Decoy Operations in 2017 and 15 Decoy Operations in 2018.) Under this scheme 40% of the award amount is given to Informant, other 40% of the award amount is given to Pregnant lady and rest 20% is given to the attendant of the pregnant lady

Indian Penal Code, 1860 Section 312: Without analyzing the threat to the life of women Section 313: Without the consent of the women Section 314: Trying to cause miscarriage and thereby causing death Section 315: An act done to prevent a child from being born/ or born alive concealing the birth of a child

Section 315 IPC Act done with intent to prevent child being born alive or to cause it to die after birth-Whoever before the birth of any child does any act with the intention of thereby preventing that child from being born alive or causing it to die after its birth, and does by such act prevent that child from being born alive ,or cause it to die after its birth ,shall ,if such act be not caused in good faith for the purpose of saving the life of the mother, be punished with imprisonment of either description for a term which may extend to ten years, or with fine, or with both.

PCTS Data In the last 3 financial years 2015-16, 2016-17, 2017-18 based on 43+Lacs birth now our Sex Ratio at Birth (SRB) increasing continuously............... It was 929 in 2015-16 and its 950 in 2017-18 (Till Feb’17) Year Sex Ratio at Birth 2015-16 929 2016-17 938 2017-18 950 Increase of 52 Points If the trend is continued for next 5 years, CSR will become around 940 for the state (in comparison of 888 as per Census 2011)
