“A hospital must protect and promote each patient’s rights” (CMS, 2011). “ You have the rights and a role regarding your treatment and care” (The Joint Commission, 2012). Patient’s Rights

Patient’s Rights Objectives At the end of this course, the participant will be able to: Define patient’s rights according to standards set by CHSB policy, The Joint Commission, and Medicare Conditions of Participation Identify how ethics may contribute patient’s rights Identify how patient’s rights and ethics may affect hospital staff Describe responsibilities of the Ethics Committee and how to request their assistance Understand the reporting process for resolution of patient’s complaints at CHSB

What are Patient’s Rights? Patients have the right to: Be informed about the care they will receive Make decisions about their healthcare Receive safe care Refuse care Know the names of caregivers who treat them Have their pain addressed Care that is free from discrimination Know when something goes wrong with their care Be listened to and treated with courtesy and respect Have a personal representative (advocate) with them

Ethics and Health Care How does ethics play a role in patient’s rights? Health care ethics is a thoughtful exploration of how to act well and make morally good choices based on beliefs and values about life, health, suffering, and death Patient’s, families, and healthcare professionals sometimes face difficult decisions about medical treatments that involve moral principles, religious beliefs, or professional guidelines

Ethics and Healthcare Sometimes the moral principles, religious beliefs, or professional guidelines may be different between the various parties involved in the decision making process. Regardless of the challenges that the patient, members of the family, or the health care team may face, the final decision of the patient should guide the patient’s health care; as long as the treatment is medically necessary, and to the extent permitted by law.

Ethics and Hospital Staff Who is responsible? Every staff member at Community hospital of San Bernardino has a responsibility to safeguard patient’s rights and make ethically and morally sound choices in all aspects of patient care, regardless of their job function. Ethics and Hospital Staff

Ethics Committee The Ethics Committee here at CHSB can assist the patient, family, or hospital staff when dealing with a serious complicated issue Anyone concerned about the care of a patient can contact the committee, whether it is the patient themselves, a patient’s representative, or hospital staff. The Ethics Committee may arrange to meet with the key people involved in the issue and provide assistance so that the patient or representative can fully understand the healthcare choices for the patient and have the ability to make informed decisions.

Ethics Committee How do I request assistance from the Ethics Committee? The Ethics Committee has a private recorded telephone line that is open to anyone Messages are checked Monday through Friday from 09:00 to 17:00 Simply call (909) 806-ISAY (1729) and leave a message with the following information: Name Phone number Your concern Best time to return your call You may also contact the House Supervisor to express your concerns In the event of an emergency situation, please contact the House Supervisor after hours or on weekends

What happens when something goes wrong? If a patient feels that it becomes necessary to file a complaint, they may utilize the following contact information: Community Hospital of San Bernardino Contact the CHSB Patient Relations Department by calling (909) 806-1256 The grievance committee will review each grievance and provide a written response. The written response will contain the name of a person to contact at the hospital, the steps taken to investigate the grievance, the results of the grievance process, and the date of completion of the grievance process. California Department of Public Health (CDPH) May be contacted regardless of whether a patient uses the hospital’s grievance process or not The address and phone number for CDPH is: 464 W. 4th Street, Suite 529, San Bernardino, CA 92401, (909) 383-4777 The Joint Commission May be contacted If a patient believes that their safety has been compromised or quality of care standards have not been met.
