Copyright Basics: Fair Use and Fair Dealing In Canada, “Fair Dealing” has two tests: The “dealing” must be for an allowable purpose: Research, private study, education, parody, satire, criticism, review, or news reporting The “dealing” must be “fair” - consider these six (and perhaps other) factors: The purpose of the dealing The character of the dealing The amount of the dealing The nature of the work Available alternatives to the dealing The effect of th dealing on the work

Managing Copyright: Options Assignment vs. License: An assignment of copyright is a transfer of a right such that the assignee is the owner of the legal interest in that right and the assignor is left without any control over the right transferred A license is a permission to do certain acts which might otherwise constitute infringement of the licensor’s right and does not involve any change of ownership in the copyright.
Managing Copyright: Options An assignment conveys ownership can be transferred, sold, or re-assigned at a later date Has a set term A license permits use Author keeps ownership Limited to rights expressly permitted Can be non-exclusive Term can be unclear; termination usually depends on notification
