Let’s start at the very beginning Medical Documents—the right start—first Durable Power of Attorney for Healthcare Durable because it endures when a regular Power of Attorney fails This document gives your spokesperson, agent, proxy—the power to make your health decisions when you are no longer capable of doing that.

Medical Documents—A Living Will A Living Will states the kind of medical treatment you wish whenever you are in a medical facility or under a doctor’s care. It is where you specify what you expect in your medical treatment as well as what you do not want as a part of your medical treatment. This is an important document because it will govern your healthcare and your healthcare options.

HEALTH INFORMATION AND PATIENT PROTECTION ACT HIPPA Authority This gives your physician and medical facility your permission to describe your medical condition , either in person or on the telephone, to others you identify. Without this document, not even your spouse, parents or significant others will be able to get information about your healthcare. Do these documents need to be notarized? It depends on the state in which you live: Some states want all documents to be notarized, have two witnesses, and require patient ID and affirmation as well as a signature. There are states which have no requirements for a notary. There are also states which require notary for only a Living Will. Know your state laws and, when in doubt, have all the documents notarized.

The Financial Documents Last Will and Testament This is the document that determines the distribution of your assets by law. Everyone has a will. You can write it yourself or your state has one prepared one for you. This will describe the assets that you choose to give to specific beneficiaries. This document must be created by a competent individual.

A Durable Power of Attorney for Finance Designating someone to handle every financial matter on your behalf This is a critically important document. Your agent must be carefully and thoughtfully chosen. The person you choose speaks for you while you are living and even if you are incompetent. You may choose to have an alternate receive copies of all transactions.

Who or what organization do you want to remember in your final giving? Legacy Giving Who or what organization do you want to remember in your final giving? Local and federal government will usually take a portion. Your children will usually be remembered—equally. The organizations you belong to and institutions you serve will not be included unless you specifically write it down. This is included in your last will and testament if you choose.

Terms You Need to know Executor—The person named in your will to carry out your wishes Bequest—A gift made through your will or estate plan Beneficiary—The person or institution named in your will to receive all or a portion of your assets Attorney-in-fact--Your designated agent for your powers of attorney Alternate—The person you have chosen if your first choice for any position in your will is not available Revocable Living Trust—This is a trust created in the lifetime of the trust author. It will hold retitled estate assets in the name of the trust. This names a trustee that replaces a probate judge. Trustee—The person named in your estate to manage the assets in your trust
