1. DEFINITIONS Restorative Justice The Child Justice Act defines restorative justice as “an approach to justice that aims to involve the child offender, the victim, the families concerned and community members to collectively identify and address harms, needs and obligations through accepting responsibility, making restitution, taking measures to prevent a recurrence of the incident and promoting reconciliation.  In other words, restorative justice is based on the tenet that young people in conflict with the law should focus on restoring the societal harmony and putting right the wrongs by being held accountable, accepting responsibility and, where possible, making amends. Family Reunification The Policy on Reunification Services of the Department of Social Development, defines family reunification as “the reunification of family members who have been separated from their families due to various reasons”. In the context of children in conflict with the law, this definition compels the reunification of the child to the custody of his or her immediate family or other family members through interventions to promote an environment conducive to the development of the strengths and skills of the parent, guardian, care-giver, family members and the child. AIMS AND OBJECTIVES OF RESTORATIVE JUSTICE AND FAMILY REUNIFICATION Restorative Justice is based on the tenet that young people in conflict with the law should focus on restoring the societal harmony and putting right the wrongs by being held accountable, accepting responsibility and, where possible, making amends.   Family Reunification is a crucial component of the Reintegration and Aftercare duties of social service professionals to increase resilience to risk factors and reverse re-offending trends to produce children, youth and adults that are responsible, productive citizens and have an urge to foster safe communities.

3. CRIME PREVENTION & SUPPORT – STRATEGIC OBJECTIVE Strategic Objective – Annual Performance Plan Reduce recidivism through an effective probation service to all vulnerable children and adults by March 2020: Target Objective Statement of Programme Reduce the extent of recidivism and vulnerability to crime by providing psycho- social and statutory services to children youth and adults within the criminal justice process by March 2020 for 19040 beneficiaries. In order to achieve this, the programme included, as one of its focus areas in the above Annual Performance Plan, the provision of a range of reintegration interventions to children in conflict with the law who completed community-based and/or residential programmes to promote stable, social and family relationships and reduce their chances of relapse and repeat offending.

4. POLICY AND LEGISLATIVE FRAMEWORK The mandate of this programme is underpinned by National and Provincial legislative and policy prerogatives such as: The Child Justice Act,75 of 2008 The Children’s Act, 38 of 2005 The Probation Services Act,116 of 1991 & 35 of 2005 (as amended) The Criminal Procedure Act 51 of 1977 The Prevention and Treatment of Drug Dependency Act 20 of 1992 The National Crime Prevention Policy, 1996, as well as The Integrated Social Crime Prevention Strategy, DSD, 2011. White Paper for Social Welfare 1997 integrated Service Delivery Model (2005) Minimum Norms and Standards for Diversions Reintegration and Aftercare Strategy for Probation Services, DSD African Charter on the Right and Welfare of the Child UN Convention on the rights of the child Integrated Provincial Violence Prevention Policy Framework , WCG, August 2013 This programme is also intrinsically linked to PSO 8 “Promoting social inclusion and reducing poverty’, particularly outcomes 3 “All South Africans feel and are safe’ and 5 ‘reducing crime’ and National Outcome 3.

5. REUNIFICATION / REINTEGRATION PROJECTS FOR CHILDREN IN CONFLICT WITH THE LAW Cape Winelands Usiko USIKO in Stellenbosch renders reunification programmes to children who have completed the diversion programmes. For the financial year 2017/2018, sixty (60) children were referred by DSD Stellenbosch local office for family reunification services for a period of one year. Family reintegration services include psycho-socio services and support in the form of an accredited Wilderness-based Therapeutic Intervention camp, Parenting Workshops, linking with job opportunities, assistance to go back to school or study at college, job-skills training (electrician, plumbing, forklift, waitressing and cooking. this project is a successful collaboration between DSD, Usiko and the private sector. 8 back to school, 6 enrolled in college, 4 trained as waiters

REUNIFICATION / REINTEGRATION PROJECTS FOR CHILDREN IN CONFLICT WITH THE LAW (cont) Cape Winelands KHULISA KHULISA renders reunification and reintegration programmes to children and parents/ caregivers who have completed the diversion programmes in Paarl and Worcester. For the financial year 2017/2018, a total of 54 children and 55 parents were referred by probation officers at the two DSD local offices for family reunification and after-care services. Family reintegration services include parent effectiveness training, Substance Abuse, Life skills, Job-readiness, Aftercare Camp, Needle-work and Gardening. Reintegration services are conducted according to a needs-based approach that will enable client’s individual needs to be addressed to promote development.

REUNIFICATION / REINTEGRATION PROJECTS FOR CHILDREN IN CONFLICT WITH THE LAW (cont) METRO SOUTH Youth Impact and Sustainable Solutions (YISS) This organisation is based in Hanover Park and renders reunification and reintegration services to children and youth released from Child and Youth Care Centres and those who completed other probation service programmes. For the 2017/18 financial year a total of 36 candidates were referred from DSD Metro South Regional Office. The beneficiaries resides in high-risk areas, such as Hanover Park, Manenberg, Lavender Hill, Mitchell’s Plain, Gugulethu, etc. The project consists of a 35 week skills-based training in Hairdressing, Barber, Bakery and Hospitality, Business skills. These training package consist of theory, practical, events, competitions and inter-generational community services. Life-skills training includes trauma counselling, anger management, interpersonal relationships, substance abuse and gangsterism. Beneficiaries are assisted with obtaining a learner’s licence. After completion of the training course each candidate receives a tool and product kit to the value of R2 000 per kit. Completion of this course enables the beneficiaries to either start an income-generating business from home, continue with further studies or find gainful employment. Parents/ caregivers participate in the orientation and graduation ceremony. Beneficiaries and their families are supported and mentored by the organisation for a period of one year after completion of the programme. Of the 36 participants: 7 employed, 11 are self-employed, 2 went back to school, 4 were enrolled in college, 7 whereabouts unknown, 2 re-offended, 2 under age for employment, 1 physically disabled
