HB 3706 Dropout Recovery Online Program– Background HB 3706 (85th) amends TEC 29.081 to specify that a dropout recovery education program can be offered on-site at a school campus or through an internet based online program. TEC 29.081(f) (existing subsection) specifies that the commissioner shall include students in attendance in a program under Subsection (e) in the computation of the district's average daily attendance (ADA) for funding purposes. The legislation expanding the dropout recovery programs to include online programs creates the need to ensure that all Texas public school students that participate in a dropout recovery program specified under TEC 29.081(a) on- campus or online are able to generate funding for the LEA where they are enrolled.
HB 3706 Dropout Recovery Online Program– Background TEC 29.081 Internet online program – (d) For purposes of this section, "student at risk of dropping out of school" includes each student who is under 26 years of age: (e) A school district may use a private or public community-based dropout recovery education program to provide alternative education programs for students at risk of dropping out of school. The program may be offered: (1) at a campus; or (2) through the use of an Internet online program that leads to a high school diploma and prepares the student to enter the workforce. (f) The commissioner shall include students in attendance in a program under Subsection (e) in the computation of the district's average daily attendance for funding purposes. HB 3706 Dropout Recovery Online Program– Background TEC 29.081 (e-2) An Internet online dropout recovery education program must: (1) include as a part of its curriculum credentials, certifications, or other course offerings that relate directly to employment opportunities in the state; (2) employ as faculty and administrators persons with baccalaureate or advanced degrees; (3) provide an academic coach and local advocate for each student; (4) use an individual learning plan to monitor each student's progress; (5) establish satisfactory requirements for the monthly progress of students according to standards set by the commissioner; (6) provide a monthly report to the student's school district regarding the student's progress; (7) perform satisfactorily according to performance indicators and accountability standards adopted for alternative education programs by the commissioner; and (8) comply with this title and rules adopted under this title except as otherwise provided by this subsection.

HB 3706 Dropout Recovery Online Program– Background The TEA School Finance staff have determined that the best way to fund the online dropout recovery programs is to use the attendance accounting rules that are authorized by TEC 29.0822 (Optional Flexible School Day Program - OFSDP). HB 3706 Dropout Recovery Online Program– Background The OFSDP allows for the funding of students on the basis of school day minutes present and allows funding on the basis of a 45- minute minimum threshold on a given school day. The OFSDP program is also primarily designed for at-risk students to allow for flexibility of daily attendance to ensure opportunities for student success.
HB 3706 Dropout Recovery Online Program– Background Additionally, the legislature, under TEC 29.959, has authorized the creation and operation of an open enrollment charter school that serves adult students, ages 26-50, and has authorized the funding of the charter school based on student attendance. While most LEAs are subject to the strict guidelines of student age eligibility of students being less than 26 years of age on September 1 of a given school year, the Excel Academy charter school is legislated to serve and be funded for students, age 26-50, who would be ineligible for ADA funding at any other LEA.

Business Meaning: Students participating in the Optional Flexible School Day Program (OFSDP) or OFSDP Online Dropout Recovery Program should be reported with at least one course transcript. Reason for revision: A campus offering the OFSDP or the OFSDP Online Dropout Recovery Program should generally report at least one course transcript for a student. Special Warning
