Madison 1800: Jefferson defeats Adams On last night in office, Adams appoints William Marbury as a judge Next day, Jefferson tells Madison not to deliver the appointment to Congress, Marbury goes to Supreme Court, cites Judiciary Act Chief Justice John Marshall says Judiciary Act is not constitutional, and nullifies the law (power of judicial review)
