ADMINISTRATIVE AND TRAFFIC LAWS CHAPTER 2 PAGE 22 1

LEQ … Why are traffic laws important? We need to know traffic laws to understand the right-of-way rules, different speed limits, and high-risk behaviors associated with driving

WORDS TO KNOW … Administrative Laws – establish the procedures for issuing and removing drivers’ licenses, for registering a vehicle, and for securing a title. Suspend – temporarily take away, usually 30 – 90 days Revoke – take license away for a year or more Point System – assigns each driver points for violations Fixed Speed Limit – a maximum or minimum speed that a vehicle may be driven on a particular road way. DO NOT CHANGE Advisory Speed Limit – advises drivers to interrupt their normal driving speed for a limited time. Provide safe guidelines for adjusting your speed. Illegal Per Se Law – makes it unlawful for a person to operate a motor vehicle with a BAC above a certain level

WORDS TO KNOW … Implied Consent Law – when receiving their license, drivers agree that if stopped for cause and charged with the offense of drinking and driving, they will take a test for the presence of alcohol. HAVE BEEN ENACTED IN ALL STATES. Aggressive Driving – high-risk behavior that threatens the safety of others, and it’s a moving traffic violation Vehicular Homicide – whenever reckless driving causes the death of another person, the driver or drivers involved may be charged and convicted of vehicular homicide

ADMINISTRATIVE LAWS ESTABLISH PROCEDURES FOR: Issuing and removing people’s licenses Graduated driver-licensing Suspend Revoke Point system Registering a vehicle Securing a title Financial responsibilities of vehicle owners insurance Establishing standards for safety equipment and care of a vehicle

ADMINISTRATIVE LAWS ____ 1. Administrative laws apply only to traffic violations. ____ 2. A point system enables the state to keep track of a driver’s violations. ____ 3. A certificate of title is the same as a certificate of registration. ____ 4. Driving tests are designed and administered by the federal government. ____ 5. You receive your license plates when you receive your certificate of title. ____ 6. For your driver’s license, you will be tested on traffic laws and knowledge of signs, care repair, and signals. ____ 7. A driver’s license that is suspended is usually taken away for a period of 10 to 15 days.

RIGHT-OF-WAY RULES Yield the right-of-way to any emergency vehicle Yield the right-of-way to people who are blind and are carrying a white cane or using a guide dog Yield the right-of-way to all pedestrians

DRIVER-CONDITION LAWS Driving while Impaired Illegal per se law – It is unlawful for a person to operate a motor vehicle with a blood alcohol concentration (BAC) above a certain level. Drivers over 21 = .08 percent in 45 states Commercial license = DWI with a BAC of .04 Under 21 = .02 percent in 37 states .01 percent in 2 states .00 percent in 11 states Implied consent laws When you receive your license you agree that if stopped for cause and charged with drinking and driving, you will take a test for the presence of alcohol This means you must agree to take a blood alcohol concentration test if requested to do so by a police officer

AGGRESSIVE DRIVING Driving at an inappropriate speed (15 to 20 mph above the posted limit) Tailgating Failing to stay in the right lane Frequent and unsafe lane changes (weaving in and out of traffic) Passing on the shoulder during heavy traffic r *
