Creating a P.L.102- 477 Plan

Development Goals Discuss plan development Contact the P.L.102-477 federal office Review the plan requirements listed in Public Law 102-477 Section 6. Also review the federal partners elements spreadsheet tool developed to assist all involved. Consider additional ideas and suggestions for plan enhancement

Plan Development Identify programs that will fit together Identify Goals Goals should be tribal initiatives Involve program staff in process Involve Community Leaders Promote program corroboration

Plan Development Have people who are familiar developing program goals for your community Keep in mind that your goal outcomes should be measurable and easily tracked and documented by program Try not to limit your program being to specific with wording in the plan Set step by step realistic goals

477 Is Integration of Programs Positive incorporation of programs Tribal council and community awareness and approval Program staff’s will to expand 477 is about providing combined related services to your people

PLAN Requirements

Plan Requirements Requirements for the plan are found in Section 6 of Public Law 102-477 There are 8 points that are listed in Section 6 that must be addressed in the plan

“It shall be pursuant to P.L.102-477 Section 4.” “Pursuant to Section 4” “Before a plan can be considered acceptable for P.L. 102-477 Sec. 6. Plan Requirements:” “It shall be pursuant to P.L.102-477 Section 4.”

Sec. 4 Integration of Services Authorized The Secretary of Interior, in cooperation with the appropriate Secretary of Labor, Secretary of Health and Human Services and Secretary of Education ,shall, upon the receipt of a plan acceptable to the Secretary of Interior submitted by an Indian tribal government, authorize the tribal government to coordinate, in accordance with such plan, its federally funded employment, training and related services programs in a manner that integrates the program services involved into a single, coordinated, comprehensive program and reduces administrative costs by consolidating administrative functions.

Sec. 6. Plan Requirements Requirement (1) identify the programs to be integrated; Normally consists of a simple list, naming each of the programs

Plan Requirement (2) Consistency with the 477 law means following the purposes of the law by: Improving the effectiveness of the tribe’s employment and training related services Reducing joblessness in Native Communities Serving tribally determined goals consistent with the policy of self determination

Plan Requirements Requirement (3) describe a comprehensive strategy which identifies the full range of potential employment opportunities on and near the tribal government’s service area and the education, training, and related services to be provided to assist Indian workers to access those employment opportunities;

Sec. 6. Plan Requirement (3) Describe service area Identifying potential employment opportunities Usually provides a brief history, geographic service area, and service population Spell out the high priority of tribal goals

Sec. 6. Plan Requirements Requirement (4) describe the way in which services are to be integrated and delivered and the results expected from the plan;

Sec. 6. Plan Requirement (4) Describes a comprehensive strategy by: Identifying potential employment opportunities Identifying issues and barriers that the tribe wants to overcome by utilizing the programs within the 477 program Identifies “menu” of services Addresses eligibility

Outreach to potential service population Limitation to services Youth services and what they will feature Detailed attention to CASH ASSISTANCE programs –GA and TANF– Childcare services should be described in detail Describes special support for economic development

Sec. 6. Plan Requirements Requirement (5) identify the projected expenditures under the plan in a single budget;

Sec. 6. Plan Requirement (5) Single budget Identify where the resources come from Develop system for tracking and identifying budget for Program Director Consider reporting needs

Sec. 6. Plan Requirements Requirement (6) identify the agency or agencies of the tribal government to be involved in the delivery of the services integrated under the plan;

Sec. 6. Plan Requirements Requirement (7) identify any statutory provisions, regulations, policies, or procedures that the tribal government believes need to be waived in order to implement its plan;

Plan Requirement (7) Waivers: Each tribe has the right to request a waiver Waivers are used to improve the system A waiver: Clearly states what regulation for which a waiver is being requested. Explains why the waiver is necessary Explain the policy which the tribe will put in place to replace the provision of law or regulation that the tribe want to waive

Sec. 6. Plan Requirements Requirement (8) be approved by the governing body of the affected tribe;

Sec. 6. Plan Requirement (8) Approval from the governing body of the affected tribe means that their must be a tribal resolution for the implementation of this law The resolution provides the support for the changes that will occur with the delivery of employment, training, and related services within the 477 plan
