House Bill 16-1141 “Concerning the protection of Colorado residents from the hazards associated with naturally occurring radioactive materials in buildings, and in connection therewith, making an appropriation” Signed by Governor Hickenlooper 4/21/2016 Required the establishment of a radon education and awareness program Providing information to citizens, businesses and others Work collaboratively with radon contractors and citizens to resolve questions and concerns regarding safe, healthy and efficient radon mitigation systems Collaborate with local governments to provide information on best practices for radon mitigation strategies Effective January 1, 2017, establish a radon mitigation assistance program to provide financial assistance to low-income individuals for radon mitigation in their homes 11/19/2018 Radon Program

Colorado Low Income Radon Mitigation Assistance Program (LIRMA) (6 CCR 1007-1 Part 21) Timeline: June 10, 2016 Public comment period for Part 21 rule begins. June 29, 2016 Stakeholder Meeting July 11, 2016 Public Comment period ends August 17, 2016 A request for rulemaking before the State Board of Health (BOH) October 19, 2016 A rulemaking hearing before the BOH Mid-December 2016 Estimated effective date for Part 21 regulation Early 2017 Program will begin receiving applications for contractor participation and assistance from homeowners   11/19/2018 Radon Program

Eligibility Homeowners must: Occupy the property as their primary residence Be a Colorado resident Qualify as a low-income household Using HUD low income limits – by county 11/19/2018 Radon Program

Mitigation Contractor Process Radon Mitigation Contractors apply to be on the list of LIRMA contractors Application Form LIRMA C1 Certificate of Fact of Good Standing from the Colorado Secretary of State (http://www.sos.state.co.us/) A current Internal Revenue Service W-9 form A copy of the NRPP or NRSB Certificate or Certification Card A valid liability insurance certificate – Insurance certificate on Accord form must have: $1,000,000 Commercial/General Liability coverage per occurrence $1,000,000 Auto Liability coverage $1,000,000 Worker's Comprehensive coverage By applying, contractor agrees to adhere to all requirements in the LIRMA policy and procedures manual If application is approved, mitigation contractor is listed as a LIRMA eligible contractor to perform mitigation system installations under the program   11/19/2018 Radon Program

Homeowner Process Homeowners apply for mitigation assistance Application Form LIRMA H1 Radon test results showing radon levels are more than 4 pCi/L (picocuries per liter) Proof of Ownership – copy of a Warranty Deed or Deed of Trust Copy of the most recent Mortgage statement Copy of the homeowners previous years Federal Income Tax Form (form 1040, 1040EZ, etc.) filed with the Internal Revenue Service (IRS) Photocopy of a current Colorado Driver’s License, State of Colorado issued Identification Card or Military Identification Card 11/19/2018 Radon Program

Mitigation Process LIRMA Program reviews homeowner application If application is approved, homeowner is sent a list of LIRMA contractors Homeowner solicits bids from contractors of their choice Funding assistance not to exceed $1,500 for mitigation system installation and post mitigation test Contractor conducts on site visit and prepares a mitigation plan Mitigation plan MUST include at a minimum: A guarantee that the system will reduce radon levels below 4PCi/L; A minimum 5 year warranty on the fan and workmanship; Compliance with contractor declared mitigation standards; A Lien Waiver for the home; and Home Owners Association (HOA) approval-if applicable. LIRMA program reviews the homeowner chosen mitigation plan If mitigation plan is approved, LIRMA program sends contractor a firm fixed price statement of work for signature 11/19/2018 Radon Program

Mitigation Process Continued Contractor signs statement of work agreeing to terms of the program Contractor obtains any necessary permits required by the local jurisdiction Contractor installs mitigation system and provides homeowner with a post mitigation test kit Homeowner conducts post mitigation radon test Contractor submits post mitigation test result evidence below 4PCi/L, invoice, photo’s of mitigation system (crawl space cover/slab penetration/other suction point location, labeling, manometer, fan, wiring and termination point) If system is compliant and meets all requirements, LIRMA program pays the contractor 11/19/2018 Radon Program
