2013 National Local Government Infrastructure and Asset Management Conference Angus Draheim General Manager Operations National Heavy Vehicle Regulator

Who we are Australia’s first national, independent regulator for all vehicles over 4.5 t GVM. Australia’s first national, independent regulator for all vehicles over 4.5 tonnes gross vehicle mass: an independent, statutory body based in Brisbane but with a national focus will evolve into a one-stop-shop for heavy vehicle road transport business with government across Australia, later in 2013. NHVR’s role: administer one set of laws for heavy vehicles under the Heavy Vehicle National Law (HVNL) minimise the compliance burden on the heavy vehicle transport industry and reduce duplication and inconsistencies across state and territory borders.

Cut duplication and inconsistencies Improve safety and efficiency HVNL Cut duplication and inconsistencies Boost innovation Improve safety and efficiency Unlock $12.4B over 20 years Cut costs and red tape One regulator under one national law will: reduce duplication and inconsistencies across state and territory borders cut costs and red tape deliver even safer and more efficient operations boost innovation unlock estimated productivity gains of up to $12.4 billion over the next 20 years.

Our strategic focus Promote public safety Promote industry productivity and efficiency Encourage regulator and operator efficiency Manage impact of heavy vehicles on the environment, infrastructure and public amenity Recognising the many challenges facing the industry and regulators, the NHVR is focused on: developing flexible and safer fatigue management programs recognising and rewarding operators who make a real commitment to safety working with industry to improve capability in managing safety with particular attention on accreditation promoting improved access to road network to maximise the value of public infrastructure working with states and territories and local government providing expert and authoritative advice to state, territory and local governments and technical support to road managers delivering value to its customers, stakeholders and partners  ensuring there is consistent and professional enforcement ensuring that chain of responsibility is effective and that customers and other parties do not encourage or contribute to any illegal or unsafe activity.

Intergovernmental agreement Reform milestones Jul 2009 COAG decision Jun 2010 NHVR Project Office Aug 2011 Intergovernmental agreement Aug 2012 HVNL Bill 21 Jan 2013 (Release 1) NHVR open for business Feb 2013 HVNL Amendment Bill 1 Sep 2013 (Release 2) Commencement of HVNL NHVR is at the heart of the most significant road transport reforms in Australia since Federation. Key dates in the history of the reform process so far: July 2009 - Council of Australian Governments (COAG) agreed to establish a single national system of laws for heavy vehicles over 4.5 tonnes - laws to be administered by an independent national regulator. February 2010 - COAG named Queensland as the host jurisdiction and the corporate base for NHVR - Queensland the first to pass the HVNL, with other states and territories subsequently applying the HVNL in each jurisdiction. June 2010 - NHVR Project Office opened in Brisbane to establish the new regulatory regime, build the Regulator’s corporate entity and facilitate transitional activities for jurisdictional service delivery areas. August 2011 - Council of Australian Governments (COAG) signed Intergovernmental Agreement on Heavy Vehicle Regulatory Reform (with the exception of Western Australia). 21 Jan – NHVR opened for business initially managing NHVAS accreditation and PBS Scheme design and vehicle approvals (Release 1) Feb 2013 – HVNL Amendment Bill passed in Queensland Parliament 1 Sept 2013 – Ministers have agreed that the HVNL will commence from 1 September 2013. NOTE – We are on a reform journey. Already Release 1, Release 2, but we are planning a series of releases as new functions and services are available Timing Key messages Ministers have agreed that the HVNL will commence from 1 September 2013. What happened to 1 July 2013? Several factors are involved, including: Parliamentary processes in the participating states and territories. Finalisation of key national systems of the Regulator. Allowing more time for Police training.

Our services - now NHVAS accreditations. Alternative compliance for fatigue, mass and maintenance Administering state/territory law (not HVNL) PBS design and vehicle approvals. Certification of vehicles Permitting etc. still with states The NHVR is undergoing a staged roll-out of services in 2013. Currently manages: National Heavy Vehicle Accreditation Scheme accreditations Performance-Based Standards Scheme design and vehicle approvals. We’ve made it easy for Australia's heavy vehicle industry to do business with us from anywhere in Australia - at any time of day or night. lodge and pay applications online through the NHVR website national contact centre open 7am – 7pm AEDT.

Our services – later in 2013 NHVR NHVAS Fatigue regulation National management heavy vehicle access National C&E approach Chain of responsibility Mass, dimension, loading Vehicle exemptions Inspection standards NHVAS Fatigue regulation The HVNL is expected to effect in the majority of states and territories later in 2013. When that happens the NHVR will be the heavy vehicle industry’s one-stop-shop for heavy vehicle road transport business with government. NHVR will deliver a comprehensive range of services and act as an information gateway for all heavy vehicle road transport business. Under a national approach to safety and compliance. NHVR will deliver: a national access management system more responsive Chain of Responsibility – including national investigations and prosecutions standardised regulations for mass, dimension and loading national inspection standards – including consistent and professional enforcement at the roadside nationally-consistent fatigue management laws – safer and more flexible programs. national coordination and management of auditing for mass-, maintenance- and fatigue-accredited operators nationally-consistent assessment and registration of industry codes of practice.

Access management NHVR issues permits and notices Road owners determine access Consistent parameters. Mapping of routes on single NHVR platform. Single application point Coordination of access decisions by all road owners *562 local governments – 683,893km roads (inc. WA) National access management system: a major body of work in roll-out of NHVR services – it’s about getting operators on the right roads more quickly ensures consistent decision making against one set of nationally-consistent parameters national online permit application and mapping system – including route maps displaying all nationally-gazetted routes operators will apply to NHVR for all access permits on any nominated route and the NHVR will liaise with road owners on operator’s behalf to secure access.

Access management – NHVR Role Consider requests for access and make the final decision to grant a mass or dimension authority. Responsible for deciding whether vehicle conditions will be included in a mass or dimension authority. Responsible for ensuring that the restricted access vehicle may be used safety. The HVNL provides that the NHVR may only grant a mass or dimension authority if: the Regulator is satisfied that the use of heavy vehicles under the exemption will not pose a significant risk to public safety; each relevant road manager has consented to the grant; and any other consents required by law have been obtained or given. National access management system: a major body of work in roll-out of NHVR services – it’s about getting operators on the right roads more quickly ensures consistent decision making against one set of nationally-consistent parameters national online permit application and mapping system – including route maps displaying all nationally-gazetted routes operators will apply to NHVR for all access permits on any nominated route and the NHVR will liaise with road owners on operator’s behalf to secure access.

Access management – road manager consent Road Managers may decide not to give consent if satisfied that the mass or dimension authority will, or is likely to: cause damage to road infrastructure; or impose adverse effects on the community from noise, emissions or traffic congestion; or pose significant risks to public safety arising from heavy vehicle use that is incompatible with road infrastructure or traffic conditions; and it is not possible to grant the authority subject to road or travel conditions that will avoid or significantly mitigate one of these relevant risks.

Access management – vehicle conditions a road manager may ask the NHVR to impose vehicle conditions to manage a relevant risk, being: potential damage to road infrastructure; adverse effects on the community arising from noise, emissions or traffic congestion; or significant risks to public safety arising from the use of the restricted access vehicle in a manner incompatible with road infrastructure or traffic conditions.

Access Management Systems National on‐line permit application and mapping system (other channels also available) incorporating: Real time information on application status NHVR issuing all approved permits Coordination of decision making by road managers NHVR issuing statements of reasons for access rejections to operators (statements provided by road managers) Route maps displaying nationally gazetted routes Details of access arrangements and requirements Case managers to be assisting applicants National system provides strong support to operators and road managers: national guidelines for vehicle assessment and route assessment to help operators make their access applications quick, accurate advice and technical support for road transport authorities and road managers, to help decision-making. NHVR also providing support for local government and industry through: national implementation of approved Local Productivity Initiatives implementation of approved National Industry Productivity Packages. All these elements give operators improved access to road network.

Supporting Local Government NHVR manage application process – improved vetting Vehicle and route assessment guidelines Advice and technical support Decision making tools Ability to charge for route assessments extension of time for the road manager to decide whether to grant consent if consultation is required with another entity. (from draft Min guideline) An important role of the NHVR is to provide assistance to road managers in making access decisions. Road managers are expected to engage with the NHVR to determine how it can assist in making an access decision. It is not acceptable for road managers to refuse to consent to a grant of access because of a lack of resources if it has not been in contact with the NHVR to determine how it may assist in the access decision making process.   Need a level of comfort from the CE and maybe Board about this point. National system provides strong support to operators and road managers: national guidelines for vehicle assessment and route assessment to help operators make their access applications quick, accurate advice and technical support for road transport authorities and road managers, to help decision-making. Supporting Local Government Pre-approval agreements Road managers outline scenarios where pre-approval is afforded under certain conditions NHVR able to provide permits to pre-approved vehicles without having to request separate consent and approval for each vehicle Aims to reduce the workload of road managers Notifications, in all cases, will be provided to road managers when a permit has been issued under a pre-approval agreement Agreements will include regular reviews Similar to Notices (which are another option) An example: a road manager may already have over-width loads up to 4.5 m wide operating on certain routes. May ask the NHVR to issue permits (with set conditions) for all similar loads on those particular routes, so that these similar vehicles do not all need individual assessments for the same scenario National system provides strong support to operators and road managers: national guidelines for vehicle assessment and route assessment to help operators make their access applications quick, accurate advice and technical support for road transport authorities and road managers, to help decision-making. Notices and Ministerial Guidelines LPIs and National Notices Approx 80 LPIs to be ready for R2 Remaining Notices to be transitioned as is under HVNL Ministerial Guidelines for Access Currently being scoped and developed Aims to provide guiding principles around access

Operational Policy and Procedures Documents on a range of topics such as: Cranes Oversize, Overmass (OSOM) vehicles Freight-related Restricted Access Vehicles (RAVS) (e.g. B-doubles, road trains) Agricultural vehicles Ultimate aim is harmonisation around areas such as: Permit characteristics (e.g. is a 1 yr period permit appropriate for a 3-axle ATC? In what circumstances?) Conditions Initial aim is to consolidate current processes and policy and where possible harmonise

Beyond 2013 Further Ministerial guidelines Improved national systems for permits and notices National Heavy Vehicle Registration Raise national regulatory effort in COR The work of the NHVR won’t finish with the launch od new services later in 2013. Among the initiatives on our Legislative Forward Work program is a national vehicle registration system. Although not currently part of that forward program, Commonwealth state and territory governments have committed to working towards a national driver licensing system.
