Overview of Civil Registration (1) In 1990, the national assembly enacted the Family registration law, which was amended in 2009 for the registration of vital events. Registration was paper-based in a family book mainly for security purposes and was administered by the Ministry of Public Security (MPS). civil registration in Lao PDR is not yet universal, and that the country has one of the lowest rates of birth registration (estimated at 34 percent in 2017) in the ASEAN
Overview of Civil Registration (2) in 2011, the Government established the Ministry of Home Affairs (MOHA) and the MOHA's Department of Citizen Management (DCM), formerly a department within MPS, was given the mandate for the registration of all vital events in Lao PDR. At the first Ministerial Conference on CRVS in Asia and the Pacific held in November 2014 in Bangkok, representative of Lao Government has committed that by 2024 all Lao citizen and the newborns are registered and received official birth certification at least 70%.
Overview of Civil Registration (3) MOHA as key organization will collaborate and work closely with concerns lines ministries to implement three main projects: The implementation of CRVS Strategic Plan; Amendment of Law on Family Registration (2009 amended); Setup the Database for the registration (CMIS). For amendment the 2009 Family Registration Law will submit to the ordinary session of the National Assembly, VIII Legislature in April 2018.
Objectives The FR Law defines principles, regulations and measures on the organization, activities, administration, monitoring and control of the family registration activities to enable the registration being precise and correct manner and systematic, comprehensive and full provision of data aiming at protecting the legitimate rights and benefits of the citizens and social security and, contributing to the development of the national socio-economic development.
Govt Policy on Family Registration Activities Govt promotes, encourages all sectors to participate in the family registration activities to ensure the correct, objective, timely, accurate, transparent and uniform process throughout the country. Govt creates favorable conditions by providing all necessary supports such as: budgets, vehicles, equipment, workplaces, including the building and development of personnel for the family registration to enabling the performance of their duties in an effective manner.
Principles of Family Registration Family registration shall comply with the following principles: Respecting and ensuring the rights of the citizens; Proceeding with the family registration organization where the concerned person is permanently or temporary residing; Proceeding in the presence of the civil registrar; Ensuring the true, objective, full, accurate, convenient, timely and transparent process; Coordinating with all persons and parties concerned to obtain correct and full data in family registration; Centralize data information management and keeping them permanent.
Scope of Application This Law applies to Lao citizens, aliens, foreigners and stateless persons who are residing or earning their livelihood in Lao PDR and including Lao citizens who are residing and earning their livelihood abroad
Types of Family Registration (1) Registration of birth Registration of family book; Issuance of identity card; Registration of marriage; Registration of divorce; Registration of disappearance; Registration of death; Registration of child adoption;
Types of Family Registration (2) Registration of paternity; Registration of appointment of guardian; Registration of change in first name and family name; Registration of change in nationality; Registration of migration; Registration of temporary residence.
Family Registration Organizations (1) Family registration organizations are govt organizations comprising of the sectors of home affairs, public security, justice and the sector of foreign affairs as representative offices of Lao PDR in foreign countries. The family registration of Lao citizens, aliens and stateless persons shall be processed with the concerned family registration sectors at the allocated level accordingly.
Family Registration Organizations (2) The family registration organizations of the home affairs sector are comprised of a Department within the Ministry of Home Affairs, provincial Divisions of Home Affairs and District Offices of Home Affairs. The rights and duties of home affairs sectors : Registration of birth; Registration of death; death by court decision; Registration of marriage; Registration of divorce; Registration of change in first name or family name; Registration of change in nationality; Registration of migration; Summarize of Vital statistics. etc;
Family Registration Organizations (3) The family registration organizations of the public security sector are comprised of a Department within the Ministry of Public Security, Provincial Headquarters of Public Security, District Headquarters of Public Security. The sectors of public security have the following rights and duties: Registration of family registration books; Issuance of identity cards; Investigation of the requests for citizen migration; Registration of temporary residence; etc;
Family Registration Organizations (4) The family registration organizations of justice sector are comprised of a Department within the Ministry of Justice, provincial Divisions of Justice and District Offices of Justice. The sectors of justice have the following rights and duties: Registration of disappearance; Registration of child adoption; Registration of paternity; Registration of appointment of guardian; Notification of registration of the disappearance of aliens, foreigners, and stateless persons to the public security sectors; etc;
Family Registration Organizations (5) The family registration of the sector of foreign affairs shall be processed with the family registration units of the representation offices of Lao PDR in abroad under the management of the Ministry of Foreign Affairs The rights and duties of such units are as follows: Registration of Lao citizens residing abroad as provided for in Article 9 of this Law ( types of Registration), except 2, 3, 11, 13 and 14; Notification of registration under their responsibility to the sector of home affairs and justice sector; etc;
Civil Management Information System (1) CMIS will be an electronic system that will facilitate the management of information of citizens and residents and contribute to the effective and efficient provision of public services. MOHA will be responsible for managing the CMIS which is expected to be interoperable with the administrative (or functional) registers of other sectors. For instance, the CMIS will be interoperable with the database for the family book and national ID card managed by the MPS or with the District Health Information Software (DHIS2) database managed by MOH.
Civil Management Information System (2) The CMIS system comprises a Citizen Portal, Population Registration System and Data sharing. Citizen Portal is to provide services for citizen complaints. CMIS Core Application (population registration system) This section is to be developed in line with Standard Operating Procedures (SOPs) for notification, registration, and certification of births, deaths, marriages, divorces, change of first name or family name, change of nationality, and registration of migration and electronic forms developed by MOHA.
