Procurement of USDA Foods Diverted to Processors Competitive Procurement Process Must Be Documented Keep on File a CN Label or a Product Formulation Statement (MPFS) Product becomes a purchased Product The state and federal laws that guide the purchase of any products, also apply to the procurement of products that contain diverted USDA foods (commodities). So, when bidding time comes around include bids for the processing or your Diverted USDA Foods (Commodities) Here are the Minimum Requirement: 1.  The process must maximizes full and open competition; 2. Awarded can only be made to responsible contractors with the ability to perform successfully; 3. Use clear discriptions of the products or services that do not restrict competition. In other words you can’t say that is has to be Acme brand. That would restrict competition. 4. Documented your procurement system. It doesn’t have to be pretty but is must be done. I’ve documented quotes written on napkins with the date and the details. This is a complex subject and I encourage you to review the Purchasing information on your yearly training disc or check out our web site. Keep Nutrition and Ingredient Information on File for SMI
