Mission ”HIS strenghtens UH’s international competitiveness by increasing and developing competences throughout the university in order to improve commercial feasibility of research based IP flow.” 11/28/2018

Services Support with Invention disclosures Utilisation plans MTAs and contracts with companies Commercialisation Invention disclosures 11/28/2018

From scattered individual patents to active portfolios Commercial feasibility ”Economy of scale” Strong link to research and development Cost efficiency Tutkimuksen toimiala 28.11.2018

University invention act Effective from 1.1.2007 Promotes identification, protection and commercialisation of inventions Applied to persons employed by the university In practise: defines who owns invention(s) Differs significantly from law on employee inventions Tutkimuksen toimiala 28.11.2018

University invention act and UH’s invention guideline Tutkimuksen toimiala 28.11.2018

Intellectual Property Rights IPR Copyrights and industrial property rights Copyrights Form of expression (Teoskynnys) Neighboring/ related rights Industrial property rights Patent Utility model Design protection (Coca Cola bottle design) Trade mark (Coca Cola) Trade names Exclusive Right in the Layout-Design of an Integrated Circuit Plant Variety Rights http://www.tem.fi/index.phtml?l=en&s=862 Neighboring rights = performance, art work of a group Tutkimuksen toimiala 28.11.2018

Ownership Open research = UH’s own funding, foundations  ownership is not defined in research contract  INVENTOR (researcher) owns Contract/ collaborative research = Funding from Tekes, EU, Academy of Finland, companies  ownership defined in research contract  UNIVERSITY OWNS INVENTION DISCLOSURE HAS TO BE ALWAYS SUBMITTED! Tutkimuksen toimiala 28.11.2018

WHY? Tutkimuksen toimiala 28.11.2018

So, what is needed to know... UH’s invention guidelines Invention disclosure Notification to invention disclosure Disclosure forms and guidelines: https://alma.helsinki.fi/doclink/209020 Tutkimuksen toimiala 28.11.2018

UH’s invention guideline OWNERSHIP = BENEFITS + RESPONSIBILITY Quality over quantity University’s resources to cases with commercial potential and committed reseacher Reward according to net proceeds Tutkimuksen toimiala 28.11.2018

So, what should I do? Invention disclosure – as soon as you have an idea Fill in the disclosure form Sign the form Send the form to HIS Tutkimuksen toimiala 28.11.2018

Processes realted to invention disclosure Tutkimuksen toimiala 28.11.2018

Processing disclosures at HIS Formal check Request for additional information Definition of ownership according to University Invention Act and information provided HIS has to send notification within 2 months from the date the invention disclosure has been accepted Tutkimuksen toimiala 28.11.2018

Notification within 2 months Proof of right to invention Open research: confirms ownership Contract research: definition of ownership  If university has the rights, commercial potential of the case will be evaluated  If the rights belong to a third party, university confirms its ownership and transfers the rights to the owner Tutkimuksen toimiala 28.11.2018

If... ..HIS doesn’t send notification within 2 months  rights will be transferred to the researcher regardless of research funding mentioned ..researcher is not utilising or publishing results arising from open research within 6 months, university can ask for the rights to the invention Tutkimuksen toimiala 28.11.2018

Contract research with companies Contract/ collaborative research Company owns results Researchers fill in invention disclosure and send it to HIS HIS oversees, that Researchers transfer rights to the university University transfers rights to the company Tutkimuksen toimiala 28.11.2018

Tekes projects Researchers transfer rights to the university University offers results to collaborators Commercial evaluation If university confirms its ownership, rights transferred to the university If university doesn’t confirm its ownership, rights will be transferred to the researchers Tutkimuksen toimiala 28.11.2018

Frame work that sets the pace Research funding Contracts Time frame Commercial potential  NO ROOM FOR CREATIVITY! Tutkimuksen toimiala 28.11.2018

It is as simple as that... Or is it? Several positions and employment contracts University invention act vs employee invention act Co-ownership with other organisations Inventor ≠ research associate Timing Scattered ownership ... Tutkimuksen toimiala 28.11.2018

Common characteristics for utilisation Market uncertainty - Current and future needs? - Industry standards? - Acceptance? - Market potential? Technology uncertainty - Will it work? - Window of opportunity? - Side effects? Competitive volatility - Current and future competition? - Competitive edge? - How to tackle? Tutkimuksen toimiala 28.11.2018

Utilisation plans and social impact Tutkimuksen toimiala 28.11.2018

Utilisation plan - Approbatur What? Solution for a problem For whom? Who needs the solution (and is willing to pay) Why? Superiority to existing methods How? How will solution meet and match market need? Tutkimuksen toimiala 28.11.2018

Utilisation – Cum Laude Prior art – what has already been done State-of-Art – current level of technology = positioning your technology Market trends and needs Identification of commercial players in the field Tutkimuksen toimiala 28.11.2018

Utilisation - Laudatur Market size Most potential customers Competitor analysis IPR field/ Freedom-to-Operate Experiments for validation/ Proof-of-Concept Industry implementation Tutkimuksen toimiala 28.11.2018

Social impact What? For whom? Why? How? When? Words with numbers make it tick! Tutkimuksen toimiala 28.11.2018
