As an advisor you must understand how money works and what can ruin plans. How money works is important How it does not work is an opposite truth but equally important!

This is a revocable living trust. What? Why? Here is one example NetLaw offers a Family Living Trust because without it, you can find future plans ruined for a family. This is a revocable living trust. What? Why?

What is it? Define please A revocable living trust states who controls your assets while you are living (you) and what will happen to your assets when you are gone. Revocable because you can change it at any time; living because you create it while you are alive; trust because you entrust it with your property.

Why do I need it? Because without it, courts can review, publicize and decide the disposition of your assets and charge fees for the service. You avoid courts and probate, and your assets pass directly to the people you want to have them—and without probate court!

Your assets are owned by the trust What is required? Your assets are owned by the trust All titles must be retitled in the name of the trust Ownership passes to your trust All assets you wish to go to the trust should be retitled

What would it say? YOUR FULL NAME and YOUR SPOUSE’S NAME as trustee of the YOUR FULL NAME and SPOUSE’S NAME Revocable Living Trust. THE DATE YOU SIGN THIS IN FRONT OF A NOTARY, IT BECOMES YOUR UDT, under trust dated_____. This is the number used for the legal date of your trust. The tax ID number is a social security number.

What does it do? Avoids the time and expense of probate when you die; Avoids multiple probates if you own assets in more than one state; Provides easier, more efficient administration of your estate; Prevents court interference at incapacity; Gives you and your family maximum privacy by avoiding public court processes Brings all of your assets into one plan controlled by one set of instructions; Makes it easier to make equitable (fair) distributions to your beneficiaries; Lets you keep assets in the trust until your beneficiaries reach the age(s) you want them to be to inherit; Can continue longer to provide for a loved one with special needs.

What else does it do? Allows assets to remain in the trust and be protected from beneficiaries’ creditors, spouses, divorce proceedings, irresponsible spending and future death taxes; Prevents the court from controlling inheritance of minor children; More difficult than a will to contest; Provides effective pre-nuptial protection; Allows for changes or cancellation at any time; Allows for professional asset management with a professional trustee; Lets you keep maximum control while you are living (even if incapacitated) and after you die; Gives you peace of mind.
