History 2002 New Jersey Mercury Task Force Report Number one source of mercury emissions in NJ is from iron and steel plants Mercury Switch Data Collection Pilot Project 2004 Switches removed from 358 vehicles, found 0.8 switches per vehicle Total cost of removal & management estimated to be $3.00 per switch Legislation Proposed March 11, 2004 Legislation Adopted March 24, 2005 NJDEP Lessons Learned

Keys to Passing Legislation Based our proposal on the Clean Car Campaign model legislation Support of Congressman Sweeney Support of environmental groups, iron and steel producers, and dismantler association Commissioner of DEP strongly supported Study showing costs of removal NJDEP Lessons Learned

Components of Legislation Manufacturers responsible for implementation Requires removal of ABS & convenience switches by vehicle recyclers & scrap facilities $2.00 bounty per switch, $0.25 per switch to DEP Manufacturers must submit Mercury Minimization Plans to Department VIN must be provided for each switch NJDEP Lessons Learned

Status of Implementation 258 Dismantlers, 7 Shredders, 6 Iron & Steel Plants Manufacturers have provided collection containers to all known facilities Subaru’s plan was approved in Oct. 2005 End of Life Vehicle Solutions (ELVS) plan has not been approved Dismantlers can collect switches prior to implementation of plans & receive bounty NJDEP Lessons Learned

Lessons Learned Be clear in definition of a mercury switch versus an assembly Time frame for distribution of collection buckets $0.25 per switch is not sufficient to cover the Department’s Enforcement costs NJDEP Lessons Learned
