Transportation Network Companies (TNCs) Virginia Department of Motor Vehicles

Background New phenomenon- technology based companies using a digital platform connecting riders with drivers. Cease and Desist Temporary Authority – Rasier, LLC/Uber and Lyft Tasked by the Senate and House Transportation Committees to perform a study Did current regulations provide a framework for TNCs to operate or amend the law? Collaborative discussions, researched other regulatory approaches – Permanent solution in our 2014 study, enacted in 2015.

2015 Legislation Key components Vehicle Registration Licensing Compliance Review

Licensing Licensed by DMV Certificate of Fitness $100,000 application fee Completed other licensing requirements 2 companies licensed - Uber and Lyft

Vehicle Registration TNC partner vehicles instate and out of state needed to be registered with DMV – NEW Visibility for passengers and LE efforts VA vehicles – Credentials, black and gold decal and updated registration card; OOS - rear window decal and registration card Compliance prior to effective date 6/4/15; electronic portal for TNC’s, upload process, other registration service outlets, and electronic workflow, VCIN look-ups Rental vehicles – industry stakeholders, no new legislation (Interim/Long-term solution) Black/orange decal and updated registration card

Compliance Review 46.2-2099.53 First Compliance Review Technology driven process using Move IT Monitored general and driver/vehicle requirements Employed random sampling methodology for reasonable level of confidence in our findings Completed our review both TNC’s were found in compliance with statute requirements Opportunities for improvements Reported our results in our December 1 report to the legislators

2017 Legislation HB2019/SB1366 – Eliminated/repealed the vehicle registration and allows an approved out of state safety inspection – Effective 3/25/2017 Final numbers: 184,988 vehicles registered VA plated - 87,382, predominant vehicle registration area being Northern VA OOS vehicles – 97,606, MD and DC highest registration states, all 50 states represented Credentials still visible up to 3 years HB2032/SB1101 – Effective 7/1/2017, new fee structure, $20 surcharge and driver transcript fee Potential new business opportunities from smaller TNC’s

2017 Legislation SB 1364 – Effective 1/1/2018, Property carrier study requested by the General Assembly to examine possible changes to Virginia’s for-hire property carrier laws to address the evolution of app and web-based property carriers. DMV facilitated a couple of meetings with stakeholders. Temporary authority: Portier, LLC subsidiary Uber Eats/Uber Rush and Instacart This legislation: Eliminates for-hire registration for property carriers, reduces the number of operating authorities we issue, eliminates the for-hire vehicle designation for smaller classes of vehicles, and sets new licensing and insurance requirements for property carriers based on vehicle weights.

Wrap-up “TNC case study is a good example that has played out internationally. VA's approach has produced positive outcomes and a model for others to follow.”
