REGULATORS EVALUATION OF TECHNOLOGY

What is regulation? A rule of order having the force of law, prescribed by a superior or competent authority, relating to the actions of those under the control of the authority. What is technology? Technology is the collection of techniques, skills, methods and processes used in the production of goods or services or in the accomplishment of pre-determined objectives. Technology can equally be knowledge of techniques and processes, which can be embedded in machines or operating platforms, without detailed knowledge or common understanding of their optimal workings.

Technology and Regulation are often posed, as adversaries Technology symbolizes markets, enterprise, and growth, while regulation on the other hand is perceived as government bureaucracy, or unnecessary control and limitation of industry growth. Regulators usually take a moralistic approach in addressing and embracing technology, without substantial understanding of the future of technology in a specific industry. This is dangerous!! Similarly, Operators take a business driven approach without full or adequate understanding of philanthropic and moralistic concerns of governments. This is Dangerous!!

Regulation should always take a pragmatic approach, as opposed to a pure moralistic approach, however, it is always necessary to strike a careful balance between the two: Pragmatic Realistic Logical Rational

It is important for regulators to appreciate the changing nature of gambling platforms and evolve with it. “How do we regulate gambling in the digital age”. Gambling is fast becoming interactive with brick and mortar of gambling establishments becoming less and less irrelevant and unattractive.

Regulation should seek to strike a balance by enhancing the benefits of the application of information technology, while endeavouring to minimise its downside consequences. Do we need to see technology as an adversary to regulation “No”. Technology can and should enhance regulation. enables computerised control and monitoring, auditing, and the implementation of consumer protection regulations.
