IEEE-SA Standards Board Bylaws on Patents in Standards May 2005 doc.: IEEE 802.11-05/0315r0 May 2005 1. IEEE-SA Standards Board Bylaws on Patents in Standards Approved by IEEE-SA Standards Board – May 2004 6. Patents IEEE standards may include the known use of essential patents and patent applications, provided the IEEE receives assurance from the patent holder or applicant with respect to patents essential for compliance with both mandatory and optional portions of the standard. This assurance shall be provided without coercion and prior to approval of the standard (or reaffirmation when a patent becomes known after initial approval of the standard). This assurance shall be a letter that is in the form of either: a) A general disclaimer to the effect that the patentee will not enforce any of its present or future patent(s) whose use would be required to implement the proposed IEEE standard against any person or entity using the patent(s) to comply with the standard or b) A statement that a license will be made available without compensation or under reasonable rates, with reasonable terms and conditions that are demonstrably free of any unfair discrimination This assurance shall apply, at a minimum, from the date of the standard's approval to the date of the standard's withdrawal and is irrevocable during that period. TGn March Meeting Minutes 05-0162-r1 (31p) May 2005 TGn March Meeting Minutes 05-0162-r1 (31p) Executive Summary (also see Chairs’ meeting doc 11-05-0095r6 and closing report doc. 11-05-0297r1): Both the TGn Sync and WWiSE proposals were updated and presented An additional 12 technical presentations we made; all were related to the proposals and associated Q&A 8 hours was devoted to Q&A – responses to email questions and questions from the floor A joint meeting with .19 was held to review the process of generating a Coexistence Assurance document A Down Selection vote was held with the result: 331 respondents, Sync 178 (53.8%), WWiSE 153 (46.2%) The 1st Confirmation Roll Call Vote was then held with the result: 322 respondents, Confirm 182 (56.5%) and Not Confirm 140 (43.5%). Since a 75% threshold must be met for the confirmation vote to pass, the vote failed Sean Coffey, (RealTech) and Adrian Stephens (Intel) accepted nominations for Technical Editor The election of the Technical Editor was tabled until the May meeting since a baseline document had not been confirmed Plans for the May meeting include the 2nd Confirmation Vote and discussion of the Time Line Bruce Kraemer, Conexant

May 2005 03-665r9 Step 17 When one proposal is left, there shall be a confirmation roll call vote either in favor of the proposal or for none of the above. The proposal shall be required to achieve a 75% majority in order to be submitted to the IEEE 802.11n Editor as the initial technical specification. If the remaining proposal fails to achieve a 75% majority, the members who voted "no" shall be requested to provide to the chair their reason(s) for voting no and what would be required to change their vote to affirmative.
