INTRODUCTION The Safety at Sports and Recreational Events Act, Act 2/2010 (SASREA) signed into law by President on 2 August 2010 Deals with two separate and distinct legal functions: Responsibility for Safety - Minister of Sports and Recreation Responsibility for Security - Minister of Police and National Commissioner of Police The Minister of Sports and Recreation has issued the Regulations The Regulation for Security in terms of the Act by the Minister of Police are in the process of being finalised The SAPS Delegations of powers are finalised and issued

PURPOSE OF THE ACT To provide for measures to safeguard the physical well-being and safety of persons and property at events To provide for accountability of event role-players (controlling bodies, event organisers and venue owners) To protect the rights of persons attending these events

DEFINITIONS Some of the relevant definition (SASREA and Safety Regulations for Minister of Sports) Authorised Member - A police official (a rank of Captain or higher) designated in terms of section 15 of SASREA as Chairperson of an Event Safety and Security Planning Committee and has overall authority to direct measures relating to safety and security at an event Safety officer – A person (with experience in dealing with events) appointed in terms of section 4(4)(a) of SASREA to assist with the planning and oversight of safety and security measures at an event. For an Event Categorized as a Medium or High Risk the Safety Officer must be registered with the Private Security Industry Regulation Authority(PISIRA) Act 56/2001 as per section 16(3) SASREA Event – Sporting, entertainment, religious, cultural, exhibitional, organizational or similar activities hosted at a stadium, venue or along a route or within their respective precinct Event Organizer - Any person who is at least 21 years of age that plans, is in charge of, manages, supervises, or holds an event or sponsorship rights to an event or in any manner controls or has a material interest in the hosting of an event as contemplated in this Act affiliate means and includes, but is not restricted to, a person who is— (a) a member of; (b) bound by the rules of; or (c) bound by contract with, a controlling body;

DEFINITIONS Venue – Any area or place, other than a stadium where an event is hosted, that has a seating or standing spectator capacity of at least 2 000 persons as certified by a local authority, within which other permanent or temporary structures maybe erected and which maybe demarcated by an enclosed or semi-enclosed permanent or temporary structure Barrier means any permanent or temporary element of a stadium or venue or along a route intended to prevent people from falling as well as to retain, separate, control, guide, protect or stop people as more fully specified and contemplated in Chapter 11 of the United Kingdom Department for Culture, Media and Sport

DEFINITIONS Inner perimeter means a barrier, within which the turnstiles and emergency gates of a stadium are incorporated; Outer perimeter means a barrier which demarcates the area of a stadium between its inner perimeter and the commencement of a stadium precinct; Safety and security role-player means a person contemplated in section 16(1)(b) of the Act: Police Officer, Disaster Management, Emergency Services, Controlling Body, Venue Owner, Event Organizer, Private Security, Stewards, Volunteers, Health and Medical Service, State Security Agency and any other role-player that the Authorized Member consider necessary ticipate

APPLICATION OF THE ACT AND REGULATIONS Event Organizer initiate the event Identify the venue which is compliant in terms of the Act Grading Certificate Electrical Certificate Fire Safety Certificate Environmental Health Certificate Structural Certificate Public Liability Certificate Event Organizer Private Security Venue Owner Submit an annual schedule or an application of event to the National Commissioner for risk categorization at least six months prior the event By virtue of unforeseen nature, the event organizer must upon initiating plans for the event forthwith submit the schedule/risk categorization application of that event The event will be categorized as either low, medium or high risk depending on the factors mentioned on Sec 6 (7(a – u)) The Authorised Member is appointed where an event is categorised as Medium or high risk,

APPLICATION OF THE ACT AND REGULATIONS RISK CATEGORIZATION: LOW RISK EVENTS (SEC 4(9)) The Event Organiser appoints the Safety Officer Safety Officer establish the event security planning committee inclusive of relevant role-players (Police Officer, Disaster Management, Emergency Services, Venue Owner, Event Organizer, Private Security, Health and Medical Service and any other role-player that the Safety Officer consider necessary Written safety plan is prepared and implemented detailing: safety measures security measures crowd management measures parking plan emergency medical plan as contemplated in the National Health Act The local police station is informed prior to the event of the event details. A copy of the safety plan is submitted to the local police station. Applicable by-laws as well as any other relevant Regulations and Legislations are complied with.

APPLICATION OF THE ACT AND REGULATIONS RISK CATEGORIZATION: MEDIUM AND HIGH RISK EVENTS In terms of section 15 (1) of the Act, the National Commissioner must designate in writing a police official who is suitably qualified and experienced in policing events, with at least the rank of Captain as an Authorized Member either in general or for a specific event National Commissioner issues High Risk certificate as stipulated in section 11 of the Act for the high risk event RESPONSIBILITIES OF THE APPOINTED AUTHORISED MEMBER (Sec 15(2)(4)) must establish an Events Safety and Security Planning Committee(ESSPC) is the chairperson of the ESSPC appoints members of the ESSPC (Police Officer, Disaster Management, Emergency Services, Controlling Body, Venue Owner, Event Organizer, Private Security, Stewards, Volunteers, Health and Medical Service, State Security Agency and any other role-player that the Authorized Member consider necessary) manages and coordinates the powers and duties of the ESSPC has overall authority to direct measures relating to the ESSPC must remain in the area of operation for the duration of the event

APPLICATION OF THE ACT AND REGULATIONS CABINET APPROVED EVENTS Cabinet approval must be obtained prior to agreeing to the hosting of an international event especially that will commit the Government in any way The department/entity intending to host an international event must consult with the Department of International Relations and Cooperation (DIRCO), which is responsible for South Africa’s overall foreign relations, before offering, bidding or accepting an invitation/request to host an event The department/entity intending to host an international event has to request a threat assessment from the National Joint Operational and Intelligence Structure (NATJOINTS) before offering, bidding or accepting an invitation or request to host an event The host department to provide source document/request letter to SAPS/NATJOINTS The NATJOINTS will determine events which require the establishment of a Priority Committee and it will issue the National Joint Operational Instruction The Chairperson of the NATJOINTS will appoint the chairperson of the NATJOINTS Priority Committee The application of SASREA is therefore activated
