Building Capacity on Protected Areas Law & Governance Module 11 Exercise 1 Thinking about Regulation of Activities and Compliance and Enforcement for MPAs Marine Protected Areas - Special Legal Considerations for National Frameworks

Background Purpose Structure Build awareness of regulating activities in the marine context and challenges posed for compliance and enforcement. Provide Learners with an opportunity to practically use their knowledge. Develop legal analysis and drafting skills. Structure Introduction to exercise (10 minutes) Large group exercise (60 minutes) Joint group discussion (30 minutes) Consolidation by Educator (20 min) NOTES FOR EDUCATOR Briefly explain the purpose of the exercise. Briefly explain the structure of the exercise.

The Exercise The Government is seeking recommendations on the regulatory framework for a proposed MPA in the ocean area of the country of Atlantis. You have been assigned to assess and make recommendations on the regulatory framework for a proposed MPA in marine waters under national jurisdiction of Atlantis. You are to work in your assigned group. You will be given a copy of the factual scenario outlining natural features of the proposed area, activities currently or potentially in the area, and main threats to the area, along with a map outlining the boundaries of the proposed MPA, and worksheet which you may use to record notes and recommendations. NOTES FOR EDUCATOR Distribute to Learner groups: A copy of Annexure A – Factual scenario for the ocean area being proposed as an MPA Map of the area (Annex B) Worksheet for notes and recommendations (Annex C) Additional paper and pencils/pens, as needed, for Learners to formulate responses. The paper may be any size that is appropriate for the facilities available at the venue of the course and the number of Learners.

The Case Study

The Task In your respective groups, carefully read through the factual scenario provided in Annex A and study the map of the proposed MPA provided in Annex B. Drawing from the knowledge conveyed in the Seminar Presentation, work together to discuss and offer recommendations on the regulatory framework needed for the proposed area if it is declared an MPA, giving particular consideration to: Which activities need regulation; How those activities might be regulated; What innovative measures could be put in place to support compliance and enforcement. NOTES FOR EDUCATOR Again, remind students that this Exercise is to develop skills on applying the knowledge gained through the Seminar Presentation. Remind the Learners to keep in mind that the specific purpose of this exercise is to become familiar with how management challenges need to be translated into provisions on regulations, enforcement and compliance specifically for MPAs, taking into account their special features, threats, and scientific gaps in marine biodiversity and how land/coastal/marine areas interact, connect, and affect each other.

Joint Group Discussion Each group will briefly present their recommendations. Drawing on contributions from the Learners, the Educator will use the pre-prepared Summary of Possible Responses as a framework for identifying specific activities needing regulation, how those regulations should be framed, and innovative measures to support compliance and enforcement. The Educator may want to distribute hard copy of the Summary to facilitate discussion. NOTES FOR EDUCATOR Ask each group to briefly highlight key recommendations. Then go through the factual scenario and pre-prepared Summary of Possible Responses to examine activities that require regulation and the particular challenges of compliance and enforcement, using the pre-prepared Summary of Possible Responses (Annex D) to guide the analysis, elicit specific additional responses. Distribute Annex D as an aid in this discussion.
