A37-9 Adopted “ESTABLISH A MANDATE” Timeframes agreed by Industry, etc. Need to make required changes to two Annexes of Chicago Convention 4 4

Progress 16 November 2010, ICAO Air Navigation Commission (ANC) considered proposals to amend Annexes 6 and 8 of the Chicago Convention Annex 6 – Operation of Aircraft: 1. Intl Commercial Air Transport Aeroplanes; 2. Intl General Aviation, Aeroplanes; and 3. Intl Operations - Helicopters Annex 8 — Airworthiness of Aircraft Establish requirements and timeframes for halon alternative fire extinguishing agents Supported alternatives with least environmental impact (e.g., Climate) while meeting fire protection performance ANC agreed to send proposals to ICAO Member States and appropriate international organisations for consultations 5 5 5

Progress Russian Federation concerned specified timeframes would have a large financial impact on the industry ANB Secretariat & HTOC co-chair met with Russian ICAO Delegate Provided further clarifications Would now agree with proposal Russian Federation HTOC co-chair would offer to provide assistance within the Russian Federation ICAO ANC met again on 2 May 2011 Forwarded proposals to ICAO Council for final approval Minimal changes (related to ICAO processes) 6 6

Progress ICAO Council met 13 June 2011 An HTOC co-chair attended per invite by the ICAO Secretary General staff All 36 Council members present Annex 6 (3 parts) and Annex 8 Required 4 separate votes of all 36 members 3 votes unanimous and 1 vote with 1 abstention (related to a non-halon issue) Proposals passed without 1 vote against halon elimination mandate 7 7

Agreement ICAO agreed upon changes: shall use fire extinguishing agents that are not listed in Annex A, Group II of the Montreal Protocol on Substances That Deplete the Ozone Layer Lavatory fire ext. systems in-production aircraft 31 Dec 11 and Handheld systems in-production aircraft 31 Dec 16 Lavatory and Engine/Auxilliary Power Unit fire systems for new designed aircraft (aircraft type for which an application for a type certificate is submitted to the State of Design on or after) 31 Dec 2014 Groundbreaking: the first time an operative Annex of the Chicago Convention was changed to address an environmental issue 8 8

Next Steps National implementation and compliance by States Continued research Cargo Bays have no viable solution yet Assessing low- or no-GWP options Monitoring inventories - ICAO will be asking its communities for halon supplies and needs and will provide to HTOC Continued ICAO-HTOC collaboration Next Stakeholder meeting is December 2011 HTOC participation from Russia and China
