Pa bryd y daeth yn ddeddf? When did it become law? Cyhoeddwyd y Mesur Cydraddoldeb ar Ebrill 27 2009 a daeth yn Ddeddf Gwlad ar 8 Ebrill 2010. The Equality Bill was published on 27 April 2009 and became an Act of Parliament on 8 April 2010

Be’ sy’ mor arbennig am y ddeddf? What’s so special about it? Mae’n casglu’r holl rannau blaenorol o ddeddfwriaeth cydraddoldeb ynghyd Mae’n cynnwys categorïau newydd o bobl It gathers all the existing pieces of equality legislation together, It includes new categories of people.

Y nodweddion “gwarchodedig” The “protected” characteristics oed anabledd ail-bennu rhyw priodas neu bartneriaeth sifil beichiogrwydd a mamolaeth hil crefydd neu gred rhyw tueddfryd rhywiol age; disability; gender reassignment; marriage and civil partnership; pregnancy and maternity; race; religion or belief; sex; sexual orientation

Sut maen nhw’n cael eu gwarchod? How are they protected? Bydd unigolion yn cael eu gwarchod fel nad ydynt yn dioddef o anghyd-raddoldeb cymdeithasol/ economaidd oherwydd un o’r nodweddion e.e. Ni ddylai neb fod dan anfantais am eu bod yn hoyw, trawsrywiol na’n hen. Ni ddylent dderbyn safon is o ofal nac addysg na chael anhawster cael gwaith oherwydd un o’r nodweddion Individuals will be protected so that they do not suffer from socio-economic inequalities because of one of the characteristics e.g. No one should be disadvantaged because they are gay, transgender or elderly. They should not receive a lower standard of care or education, or be unable to get work due to one of the characteristics

Gwahaniaethu uniongyrchol Direct Discrimination Mae rhywun yn cael ei drin yn llai ffafriol na rhywun arall Mae’r gwahaniaethu’n amlwg e.e. fedrwch chi ddim dod yma am eich bod mewn cadair olwyn Someone is treated less favourably than someone else. This discrimination is obvious, e.g. you cannot come here because you use a wheelchair.

Gwahaniaethu Anuniongyrchol Indirect Discrimination Gall cyflogwr osod amod i’r holl staff a fydd yn effeithio’n negyddol ar rai grwpiau e.e. Cosb am absenoldeb salwch Gwneud i staff weithio goramser heb rybudd An employer may impose a requirement for all staff that will adversely affect some groups e.g. Penalties for sickness absence Making people work overtime with no notice

We know all about your brother! Gwhaniaethu drwy gysylltiad Discrimination by Association Nid oes gennych chi nodwedd gwarchodedig ond mae rhywun agos atoch yn perthyn i un o’r grwpiau hyn. Mi allech fod yn briod â pherson du, neu yn chwaer i rywun hoyw e.e. Rydych yn cael eich gwatwar yn y gwaith am fod eich brawd wedi ffurfio partneriaeth sifil gyda’i gariad This is where you do not have a protected characteristic, but someone close to you does. It could be that you are married to a black person or have a sister who is gay. e.g. You are hassled at work because your brother has just gone through a civil partnership with his boyfriend. We know all about your brother!

Gwahaniaethu drwy Ganfyddiad Perception Discrimination Rydych yn edrych fel petai gennych un o’r nodweddion gwarchodedig ond, mewn gwirionedd, does gennych ddim e.e. Mae gennych groen naturiol dywyll neu rydych yn arddel osgo benywaidd You may look as if you have a protected characteristic, but do not actually possess it. e.g. having naturally dark skin, looking “camp”

Aflonyddwch Harassment Ymddygiad annymunol mewn perthynas â nodwedd gwarchodedig gyda’r bwriad neu’r effaith o dramgwyddo ar hunan-barch unigolyn neu o greu amgylchfyd bygythiol, gelyniaethus, diraddiol, sarhaus neu ymosodol i’r unigolyn hwnnw. Unwanted conduct related to a relevant protected characteristic, which has the purpose or effect of violating an individual’s dignity or creating an intimidating, hostile, degrading, humiliating or offensive environment for that individual.

Aflonyddwch Trydydd Parti Third Party Harassment Aflonyddwch gan rywun sy’n gysylltiedig â sefydliad ond heb fod yn rhan ohono Gallai hyn fod yn is-gontractiwr ar safle’r coleg sy’n gwneud sylwadau sarhaus yn eich clyw Harassment by someone connected to but not actually a part of your organisation. This could be a sub contracted worker at college making offensive remarks in your hearing Haia Secsi!
