A Guide in the Work Environment Bananas! A Guide in the Work Environment

WE share 50% of our genes with a Banana. Get over ourselves!

Hostile Work Environment Exists when an employee is uncomfortable going to work because of an offensive, intimidating, or unpleasant atmosphere.

Who is Responsible? EVERYONE For Allowing the Situation AND Expecting the Person to Tolerate the Situation

Discrimination ….making a Distinction. ….making a Difference between things. We CHOOSE to Discriminate.

Any act or remarks regarding age, race, color, gender, sexual orientation, or physical & mental disabilities.

Veteran & Marital Status Parental & Medical Status Physical Appearance & Genetics Political Beliefs Arrest Record Tobacco Use

B F O Q In employment, a bona fide occupational qualification (BFOQ) is a quality or an attribute that employers are allowed to consider when making decisions in hiring.

Discrimination is the actual Behavior. Referring to the treatment taken toward or against a person of a certain group in consideration based solely on class or category.

Harassment is understood as behavior intended to disturb or upset. Sexual Harassment refers to persistent and unwanted sexual advances, typically in the workplace. Government Code Section 12940 Prohibits Discrimination and Harassment

What About Free Speech? Public- off work, free speech Private Organizations- Regulate employee speech to forbid harassment & discriminatory language

Making Diversity Fashionable The concept of diversity encompasses acceptance & respect. It means understanding that each individual is unique. It is the exploration of these differences in a safe, positive, and nurturing environment. It is about understanding each other and moving beyond simple tolerance to embracing and celebrating the rich dimensions of diversity contained within each individual.

Conduct Unbecoming Inappropriate Behavior Verbal Physical Non-Verbal ~ Visual Forms Sexual Favors Title 2-CCR Section 7257.6

Unbecoming Types Disparate Treatment ~ intentional discrimination and harassment ~ it is the Situation Disparate Impact ~ proven by statistics ~ a policy creates unfair obstacle

Reasonable Person Standard A single incident is not illegal Frequent and pervasive Creation of undue and unnecessary hardship

A corrective action is a change.

Quantum Potential If you give sperm, they'll create a baby. Whatever you give a person, they can make greater. If you give sperm, they'll create a baby.  If you give a house, they'll create a home. If you give groceries, they'll create a meal.  If you give a smile, they'll create a grin. People can multiply and enlarge what is given to them.  So, if you give them any crap, be ready to receive a ton of shit.

Good Leaders are like the Best Conductors ~ they Reach beyond to notes to the Magic inside the Players. ~ Blaine Lee
