Outline Guidance on Environmental Quality Standards for WFD Priority Substances Mandate of the Expert Group on EQS The process The consultations Policy issues of the EQS Guidance to the attention of SCG Next steps

Mandate of the EG-EQS sub group for EQS setting To develop comprehensive guidance for deriving EQSs that comply with Annex V of the WFD Develop interim methodology Help the Commission to derive EQSs Guidance should: be consistent with REACH guidance as far as possible balance best science with achievability be applicable to revised list of Priority Substances and ‘Specific Pollutants’ The role of the ORG_WB sub group is … The sub-group is made of 13 participants having expertise mainly in chemistry, ecotoxicology and risk assessment in fresh and marine waters. They belong to academies or to the industry sector. Tatiana is the Temporary Rapporteur up to now.

Mandate of the EG-EQS sub group for EQS setting Revise the methodology for EQS setting • based on existing guidance (Lepper 2005) take account of SCTEE comments (2004) and gaps identified by Bonnomet and Alvarez (2006) consistent with EU TGD (2003) and incorporate REACH guidance (RIPs) or highlight any deviations and their significance take note of other documents e.g. SETAC Workshop on Standards 2006 The role of the ORG_WB sub group is … The sub-group is made of 13 participants having expertise mainly in chemistry, ecotoxicology and risk assessment in fresh and marine waters. They belong to academies or to the industry sector. Tatiana is the Temporary Rapporteur up to now.

Environmental Quality Standards EQSs are key tools in assessing and classifying chemical status and can therefore affect the overall classification of a waterbody under the WFD. EQSs will be used to set discharge permits to waterbodies, so that chemical emissions do not lead to EQS exceedance within the receiving water. Environmental Quality Standards (EQSs) establish a threshold concentration for a chemical which, if met, allows the chemical status of the waterbody to be described as ‘good’. EQSs for those substances identified by the EU as Priority Substances (PSs) and Priority Hazardous Substances (PHSs) are derived at a European level and apply to all Member States.

Consultation (1) First draft guidance made available December 2008 Round of comments and Expert meetings and consultation with WG-E (March and October 2009) New version made available in September 2009 Testing of EQS Guidance by INERIS on a number of Priority Substances Meeting of rapporteurs at JRC-Brussels in October 2009 Comments by INERIS (DGENV Consultant) after testing of EQS Guidance performed on a number of Priority Substances SCG (November 2009) requested the formal adoption by WG-E Revised version of 25th November 2009 distributed to WG-E

EG-EQS Response to Consultation (2) Revised version of 25th November 2009 distributed to WG-E Submission for Comments to WG-E until 14 Dec 2009 Comments received from FR, UK, SE, DE, NL, DK, UK, CEFIC, ECPA, FEAP, Navigation Task group, CONCAWE Revised version sent on 7th January 2010

Discussion of main issues Based on the comments received and the responses by the rapporteurs we have identified a number of main issues that have important policy implications that will be discussed on the first part of the meeting. These are the following (section and line numbers refer to the guidance pdf version of 7 January): 1/ Section 3.5: Metals: manageability of the BLM approach 2/ Section 3.8.1: Compliance with EQS for water: conversion to total concentration 3/ Section 3.9: Deriving quality standards for water abstracted for drinking water 4/ Sections 5.1 and 5.3: Character and use of sediment EQS 5/ Section 3.3.1.1: use of blue-green algae in deriving EQS for water (lines 1755-1761). (This point has been requested by FEAP, Federation of European Aquaculture Producers. Representatives of FEAP will attend the meeting).
