Worse circumstances for undocumented migrants 2001 New Aliens Law Less rigths for migrants whose application had been denied but cannot go back. No support, no shelter for an increasing amount of migrants, living on the streets Stay in parking buildings as group and asking for help by visible action 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting
Reaction of the churcH Long tradition (national and local) in helping (undocumented) migrants Worried about the situation, working together with municipalities and others NOG’s and make a common statement: The state is creating this situation, which is in violation of its commitments under the European Social Charter 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting
Proces January 2013 the Protestants Church, through the Conference of European Churches, formally lodged a complaint against the State at the European Commitee for Social Rights of the Council of Europe. Central of the complaint was the fact that, by withholding food, shelter and clothing to undocumented migrants was endangering their right to life and to humane treatment. 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting
Motivation President pastor Ds Arjan Plaisier The Bible exhorts us to protect human dignity. Every human being was created as an image of God. That applies explicitly also to people obliged to live in the streets. The church can do no other than rise to defend our dignity 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting
ECSR Judgement The Committee request for an immediate measure six month later, in a preliminary judgement, finds that the present situation threatens to do irreparable harm to life and psysical integrity by withholding basic support, food and clothing 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting
Decision The committee confirmed that the State in this matter is in violation of its obligations under the Charter. It also states uneguivocally that the present system violates human dignity and the Charter cannot be limited to people residing legally in the country 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting

The Church involved This proces was a logical step for the Church after many years seeking for solutions for people living in very precariousness circumstances Using the human right system because this gives an opening to change the situation which was endangering human diginity of many people Linked to the vision of the Church that people are creations of God and we have to stand for dignity of live. 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting
Conclusion primary The Human Rigths Based Approach gives the possibility to ask the autorities, who are responsible, to change their policy which created a bad situation for people but also for the society Clear connection between the Christian vision and values and the key point of the complaint. The goal of diaconal work is bringing hope, sharing Gods love, take care of every human being and stand up for their rights when they cannot do it by their own. 12/31/201812/31/2018 Eurodiaconia – M&E Network meeting
