# 10 –Do employees have to use FMLA for qualifying absences? Why? Maybe – it depends on the leave balance Yes – it is to be administered consistently No – it is at the employee’s discretion No – it is at the employer’s discretion

#9 – Can I replace an employee when FMLA ends if she can’t return to work? Maybe – it depends on the circumstances Yes – so long as you notify the employee No – not until the employee has exhausted sick leave No – not if the employee is making a good faith effort to return to work We must engage in an interactive process with the employee prior to making a decision to replace the employee – work with HR using the Reasonable Accommodation Procedure to comply with ADA.

IRS Guidelines State Personnel Board Rules Fair Labor Standards Act All of the Above Employers must retain accurate time records for all employees unless they are exempt Any hours worked must be reported Hours worked over 40 = OT / comp time (1.5X)

#7 – Are FWS employees subject to Positive Discipline? Yes No Only full time employees with 12 months of service are eligible for Positive Discipline per TCSG policy.

#6 – What restricts part time employees’ hours to 29 hours for 9 months? Affordable Care Act Fair Labor Standards Act State Personnel Board Rules Teachers Retirement System Part time employees working 20 or more hours can be eligible for TRS. We limit period of employment to 9 months so the positions can be defined as “temporary”. Each 9 months, the employee must have 30 day break in service then can be rehired.

Place her on Reminder 1 (Positive Discipline). Dock her pay if she exhausts leave balances. Schedule a meeting to discuss the impact on students. The first step of Positive Discipline is coaching. Helping instructor to understand the impact of her actions can lead her to solve this problem on her own, without formal discipline.

Classified as Adjunct; can work up to 29 hours, includes prep. Classified as Lab Assistant; can work up to 29 hours, no prep. All instructors are to be categorized as Adjunct Instructors.

Any gift over $25 is prohibited by the Order to avoid appearance of conflict of interest, maintain public trust, safeguard ability to make objective, fair, impartial decisions. Avoid even the appearance of a conflict of interest.
