Agreement Background Nutrient control Agreement for Tar-Pam point sources Initiated 1990 in response to Tar-Pam NSW designation Cost-effective option to reduce collective discharge Parties to Agreement Point Source “Association” – 16 members Division of Water Resources Division of Soil & Water Conservation Pamlico-Tar River Foundation Environmental Defense

Agreement Background Collective annual end of pipe N&P caps Caps based on performance goals 30% Reduction N No increase in P Relative to 1991 Baseline Association funds Ag Cost Share BMPs if it exceeds cap Rate $29/kg N Currently well below N&P Caps

Agreement History Tar-Pam NSW Designation (1989) Phase I (1990-1994) Association formed – Collective declining caps Estuary Model Completed Phase II (1995-2004) Caps based on performance goals – Fixed collective caps NPS reduction requirements established Phase III (2005-2014) Maintains Phase II caps - adjusted for membership changes

Phase IV Agreement Negotiations Met w/ Parties to address Agreement refinements Banked credit & credit life Updating N offset rate & establishing P offset rate Evaluation of Progress Worked together to incorporate individual limits Response to directive from EPA Result is similar to approach used in Neuse Basin Both group and individual permits Individual limits enforceable if group cap exceeded

Next Steps Finalize revisions to draft of Phase IV Agreement Parties Review & Approve Draft Agreement Agreement to November WQC & EMC for approval Phase IV Agreement In Place (January 1, 2014 – December 31, 2024)
