Tinker v. Des Moines (1969)

What Happened? Students were suspended for wearing black armbands in protest of the Vietnam War.

The school had violated the students’ First Amen. rights. The Decision The school had violated the students’ First Amen. rights.

Students are citizens and are entitled to freedom of speech. So what? Students are citizens and are entitled to freedom of speech.

Hazelwood v kuhlmeier (1988)

What happened? The principal pulled two stories from the school newspaper. The students claimed their right to free speech (press) had been violated.

Issue Does the 1st Amen. protect schools sponsored publications from censorship by school authorities?

The decsision School-sponsored student publications are NOT protected by the 1st Amendment.

So what? School officials are free to censor student publications as long as those restrictions serve a valid educational purpose.

What happened? Florida’s votes were delayed because of problems with voting and counting the votes. The Florida Supreme Court ordered a hand recount.

The issue Did the lack of standards for manual recount of votes violate the “Equal Protection Clause” and due process rights in the 14th Amendment?

The decision The Supreme Court stopped the recount because there were no uniform standards.

So what? George W. Bush became President even though Al Gore having more popular votes.
