Background Who we are and what do we do?

What is the PRHP? A devolved Scottish tribunal established by the Housing (Scotland) Act 2006 – Independent / impartial/ judicial body Interprets and Applies the law and has statutory procedural regulations Judicial membership appointed by public appointment process - JABS Administration provided by Scottish Courts and Tribunals Service

What cases are considered Determine referrals from tenants concerning the duty of landlords to meet a minimum standard of repair – repairing standard Objections to fair rents fixed by rent officers / or assessing market rents and terms Assisting Landlords to enforce their rights of access for inspection/ for works

Who are the Panel members? President/ Vice President/ chairpersons/ surveyor members/ housing members When application is received it goes through an sifting process and is referred to a Committee for determination if a valid application Committee consists normally of legal chairperson, and surveyor member Committee can use own specialist knowledge and experience to determine the application

How we work? Based in Glasgow along side Homeowner Housing Panel – same membership Funding provided by Scottish Government Sits throughout Scotland - hearings are public and held close to the property after property inspection Proportion of Judicial Members are also accredited mediators

Fees/Expenses No fee for bringing an application No risk of expenses at prhp stage Only risk of expenses at appeal stage in Sheriff Court at Sheriff’s discretion Legal Aid is available to eligible tenants Parties on Legal Aid may have degree of protection in relation to expenses
