ANTI TRUST STATEMENT IPC standards shall be developed in accordance with applicable antitrust and competition laws, and meetings amongst competitors to develop IPC standards are to be conducted in accordance with these laws. It is a practical impossibility to delineate the permissible limits of discussion at an IPC meeting, because so much is dependent upon the context in which any particular subject is to be raised. Nevertheless, a prudent rule, which is to be followed at all IPC meetings, is that no commercial topics be acted upon or even considered. To avoid the most sensitive areas, there should never be a discussion of the following at IPC meetings: 1. Price or any elements of price or pricing policies, including costs, discounts, etc. 2. Sales or production quotas, territories, allocations, boycotts or market shares. 3. Identified individual company statistics, inventories or merchandising methods. 4. Particular competitors or customers. 5. Commercial liabilities, warranties, guarantees or the particular terms and conditions of sales, including credit, shipping and transportation arrangements. 6. Anything dealing with "arm-twisting," trade abuses or excluding or controlling competition.

THE PRINCIPLES OF STANDARDIZATION In May 1995, the IPC's Technical Activities Executive Committee adopted Principles of Standardization as a guiding principle of IPC's standardization efforts Standards Should: • Show relationship to DfM &DfE • Minimize time to market • Contain simple (simplified)language • Just include spec information • Focus on end product performance • Include a feedback system on use and problems for future improvement IPC Standards and Publications are designed to serve the public interest through eliminating misunderstandings between manufacturers and purchasers, facilitating interchangeability and improvement of products, and assisting the purchaser in selecting and obtaining with minimum delay the proper product for his particular need. Existence of such Standards and Publications shall not in any respect preclude any member or nonmember of IPC from manufacturing or selling products not conforming to such Standards and Publication, nor shall the existence of such Standards and Publications preclude their voluntary use by those other than IPC members, whether the standard is to be used either domestically or internationally. Recommended Standards and Publications are adopted by IPC without regard to whether their adoption may involve patents on articles, materials, or processes. By such action, IPC does not assume any liability to any patent owner, nor do they assume any obligation whatever to parties adopting the Recommended Standard or Publication. Users are also wholly responsible for protecting themselves against all claims of liabilities for patent infringement. Standards Should Not: • Inhibit innovation • Increase time-to-market • Keep people out • Increase cycle time • Tell you how to make something • Contain anything that cannot be defended with data

PATENT POLICY There is no objection in principle to drafting a proposed IPC document in terms that include the use of a patented item if it is considered that technical reasons justify this approach. IPC shall not be responsible for identifying all patents for which a license may be required by IPC Standards or for conducting inquiries into the legal validity or scope of those patents that are brought If IPC receives a notice that a proposed IPC standard and specification may require the use of a patented invention, the procedures below shall be followed. Prior to approval of such a proposed IPC standard, the IPC shall receive from the identified party or patent holder (in a form approved by the Institute) either: A): assurance in the form of a general disclaimer to the effect that such party does not hold and does not currently intend on holding any invention the use of which would be required for compliance with the proposed IPC or assurance that: A license will be made available without compensation to the applicants desiring to utilize the license for the purpose of implementing the standard; or B): a license will be made available to applicants under reasonable terms and conditions that are demonstrably free of any unfair discrimination. If neither A or B are met, IPC will evaluate whether the patented technology is essential” to the implementation to the standard, and if it should be retained in the document. If it is deemed “essential” and A or B do not apply, the technology cannot be included in the document When IPC receives from a patent holder the assurance above, the standard shall include a note as follows: Note: The user's attention is called to the possibility that compliance with this standard may require use of an invention covered by patent rights. By publication of this standard, no position is taken with respect to the validity of this claim or of any patent rights in connection therewith. The patent holder has, however, filed a statement of willingness to grant a license under these rights on reasonable and nondiscriminatory terms and conditions to applicants desiring to obtain such a license.
