Regulatory Changes and Industry Engagement Adam Johnson My original intent today was to talk to you about the upcoming changes in the Remediation Guidelines that were to take effect January 1st 2019. Part of the motivation of my company asking me to prepare this presentation was to bring a consistent awareness of upcoming changes to our contemporaries, in other words they wanted me to scare everyone else with environmental ambiguity as much as I’ve scared them, so that we all play fair. The day after confirming that I was going to attend the sector meeting, I received an email asking for feedback regarding the draft versions of the Remediation Certificate and Tier 2 Compliance Letter Guides. As I began my review of the documents I started to consider how this was going to affect my presentation and what everyone else’s interpretation of the draft documents would be. Then I questioned where this email was coming from and who else was involved in the review process. I couldn’t' see email addresses to any other highway maintenance contractors and it drove me to change my scope. I still want to provide a very basic perspective on some of the regulations, so that you have that ambiguous discomfort about environmental concerns, but I was also want to give an endorsement to ARHCA’s Environmental Committee.

Lately, the components to these steps have been under review and revision. Step 1 is developing an understanding of the Alberta Tier 1 and Tier 2 Remediation Guidelines. These guidelines set an objective target for most contaminants in soil and groundwater. The most recent version of these guidelines came into effect May 1, 2016. Additional guidelines are also set out Step 2 is actually discovering conditions onsite. Part 1 – Soil and Groundwater Remediation Guidelines Alberta Tier 1 Soil and Groundwater Remediation Guidelines February 2, 2016 Part 1 is developing an understanding of the Alberta Tier 1 and Tier 2 Remediation Guidelines. These guidelines set an objective target for most contaminants in soil and groundwater. The most recent version of these guidelines came into effect in 2016. Additional guidelines are also set out and include Environmental Quality Guidelines for Alberta Surface Waters (updated March 28, 2018) and Salt Contamination Assessment and Remediation Guidelines (not reissued since May 2001…) Alberta Tier 2 Soil and Groundwater Remediation Guidelines February 2, 2016

Part 2 – Assessment and Reporting Alberta Environmental Site Assessment Standard March 1, 2016 Part 2 is actually discovering conditions onsite. The Alberta Environmental Site Assessment Standard provides a framework for characterization and reporting at contaminated or potentially contaminated sites in Alberta. The steps in this standard include Phase 1 ESA, Phase 2 ESA, confirmatory investigation and reporting.

Part 3 – Risk Management Alberta Risk Management Plan Guide October 31, 2017 Alberta Exposure Control Guide May 3, 2016 Part 3 is risk management which involves removal or mitigation. The Risk Management Plan Guide is to provide a format for developing a site specific risk management plan when contamination is discovered. Many of these documents are seen referenced in the Environmental Management Plan Guide drafts.

Part 4 – Regulatory Closure Site- Based Remediation Certificate Guide 2019 Tier 2 Compliance Letter Guide 2019 Finally this leads to Part 4 – Regulatory Closure. When leaving a previously used site for any reason (end of lease, selling the facility, change of contract) there may be a reason to apply for a Remediation Certificate. What are you going to do about future planning? Reduce Financial Impact Targeted Goals Participate and set Industry Standards? Being more conscious and planning ahead? The common theme is that regulations are in rapid state of change and one of our best options is to participate in these changes.
