ID&R Vocabulary Migratory Qualifying Worker: Migratory Child: An individual who, in the preceding 36 months, made a Qualifying Move and, soon after the move, engaged in new qualifying work. Migratory Child: A child who is; (1) younger than 22 years of age; (2) entitled to a free and public education under State law; (3) made a Qualifying Move in the preceding 36 months as, with or to-join or precede a Migratory Qualifying Worker.

ID&R Vocabulary Qualifying Move: (both worker and child must make a Qualifying Move) A move that was: Made due to economic necessity; and From one residence to another residence; and From one school district to another school district Made within the last 36 months Qualifying Work: Work that is temporary or seasonal employment, or for personal subsistence, in agriculture or fishing According to April 2018 OME Q&A –Going through orientation is considered being engaged.

School Completion Make sure the child/youth has: NOT graduated from high school; NOT earned a GED. The child must still be eligible for free & public education in Louisiana. 2017 Non-Regulatory Guidance, Chapter II, A1

Time of Moves Both the Migratory Qualifying Worker’s Qualifying Move and the Migratory Child’s Qualifying Move must have occurred within 36 months of the eligibility interview. Once a child is deemed eligible, they are eligible for 36 months from their Qualifying Arrival Date (QAD). 2017 Non-Regulatory Guidance, Chapter II, C1, & C2

Age Make sure the child/youth is younger than 22 years of age. 0 to under 3 years of age –Eligible for MEP count 3 to 21 years of age –Eligible for MEP count and funding 2017 Non-Regulatory Guidance, Chapter II, A1

Moves Make sure the Migratory Child and the Migratory Qualifying Worker made a Qualifying Move. 2017 Non-Regulatory Guidance, Chapter II, A1, C1, & C2

must have been: All criteria must be met The Migratory Child’s and the Migratory Qualifying Worker’s Qualifying Moves must have been: Due to economic necessity From one residence to another From one school district to another AND AND All criteria must be met 2017 Non-Regulatory Guidance, Chapter II, D1

The Child’s Move… The Migratory Child moved “as” the Migratory Qualifying Worker The Migratory Child moved “with” a parent/guardian/spouse who IS a Migratory Qualifying Worker The Migratory Child moved “to-join” or “precede” a parent/guardian/spouse who IS a Migratory Qualifying Worker As, with, to join or precede the Migratory Qualifying Worker 2017 Non-Regulatory Guidance, Chapter II, A1

Presently Engaged / Previously Engaged in Qualifying Work Soon After the Move (within 60 days), the individual engaged in new: Seasonal or Temporary; AND Agricultural or Fishing work 2017 Non-Regulatory Guidance, Chapter II, C1, C2, & C5

Migrant Family Scenarios

Scenario 1 On May 1, 2018 Ms. Petra Peña age 28, moved from Arkansas to Ouachita Parish with her 3 children Jose Peña, 8, Benjamin, 6 and Paulo, 4. Petra immediately began working planting sweet potatoes two days after the move. The Louisiana MEP Recruiter did a home visit on May 15, 2018. Does the family qualify for the Louisiana MEP?

Does PETRA meet the definition of a Migratory Qualifying Worker? An individual who, in the preceding 36 months, made a Qualifying Move and, soon after the move, engaged in new Qualifying Work. Yes! Petra made a qualifying move from Arkansas to Ouachita Parish on May 1, 2018 and immediately began work planting sweet potatoes. ***As a reminder: ALL boxes must be checked off in order for the individual to meet the definition (unless check one is specified) of a Migratory Qualifying Worker and get the status.

Do the children meet the definition of a Migratory Child? Migratory Child: A child who is; (1) younger than 22 years of age; (2) entitled to a free and public education under State law; (3) made a Qualifying Move in the preceding 36 months as, with, to-join or precede a Migratory Qualifying Worker. Yes! The children are all under 22 years old, entitled to free public education and made a qualifying move with Petra, who is a Migratory Qualifying Worker, from Arkansas to Ouachita Parish on May 1, 2018. ***As a reminder: ALL boxes must be checked off in order for the individual to meet the definition (unless check one is specified) of a Migratory Qualifying Worker and get the status.

What is the Qualifying Arrival Date? The date that both the Migratory Child and the Migratory Qualifying Worker complete the qualifying moves. The child must have moved as, with, to join or precede the Migratory Qualifying Worker. This date begins the child’s 36 months of eligibility in the Migrant Education Program May 1, 2018 The Migratory Children made a qualifying move with the Migratory Qualifying Worker on May 1, 2018, soon after which the mother began work planting sweet potatoes. The children will be eligible for the Louisiana MEP until April 30, 2021. ***As a reminder: ALL boxes must be checked off in order for the individual to meet the definition (unless check one is specified) of a Migratory Qualifying Worker and get the status.

Scenario 2 Mr. Marcos Perez left his family in Tamaulipas, Mexico and moved to Farmerville, Louisiana on Feb 1, 2017 to plant seedlings for a forestry company. On June 1, 2017, Marcos, moved back to Tamaulipas to care for his mother who was ill. On August 30, 2018, Marcos, his wife and Marcos Jr., 8 years old, moved to Farmerville to work in a restaurant. The Louisiana MEP Recruiter visits the family on January 8th, 2019. Do the children qualify for the Louisiana MEP?

Scenario 2 Marcos moved from Mexico to Lincoln Parish on 2/1/17 to plant seedlings Marcos moved back to Mexico on 6/1/17 Whole family moved from Mexico to Lincoln Parish on 8/30/18 to work in a restaurant. The MEP recruiter interviews the family on January 8th, 2019.

Does MARCOS meet the definition of a Migratory Qualifying Worker? An individual who, in the preceding 36 months, made a Qualifying Move and, soon after the move, engaged in new Qualifying Work. Yes! Marcos made a Qualifying Move from Tamaulipas, Mexico to Farmerville, Louisiana on 2/1/17 and planted seedlings soon after the move.

Does the MARCOS JR meet the definition of a Migratory Child? Migratory Child: A child who is; (1) younger than 22 years of age; (2) entitled to a free and public education under State law; (3) made a Qualifying Move in the preceding 36 months as, with or to-join or precede a Migratory Qualifying Worker. Yes! Marcos Jr. is 8 years old, entitled to free public education and made a qualifying move from Mexico to Farmerville on 8/30/18 with his father Marcos, who is a Migratory Qualifying Worker. ***As a reminder: ALL boxes must be checked off in order for the individual to meet the definition (unless check one is specified) of a Migratory Qualifying Worker and get the status.
